<br />hour of 6:30 o'clock P.NI., Central Standard Time, and the office of the Board in said
<br />City as the place, when and where all persons whose property may be affected by such
<br />proposed improvement, may be heard, and all petitions and remonstrances, received and
<br />the Board will, on said day, decide whether the benefits accruing to abutting and ad-
<br />jacent property, and to the City of South Bend, Indiana, will be equal to or exceed the
<br />estimated cost of said improvements. The Clerk of the Board is hereby ordered to give
<br />notice by two weekly publications, of the time and place of hearing of these resolutions,
<br />adopted on this 6th day of July, 1954 and to be published on July 9th and July 16th, 1954
<br />The Board next examined and approved Contract Supplement No. 3, dated June 30, 1954,
<br />:pertaining to the Sewage Treatment Plant construction.
<br />To correct minor discrepancies in a previous resolution relative to the acquiring
<br />of easement rights required in connection with the location and construction of the
<br />necessary river crossings, lift stations and appurtenances, the following _resolution was
<br />iadopted : .
<br />WHEREAS this Board has heretofore been empowered., by appropriate ordinance, to build
<br />construct and acquire a sewage disposal plant with necessary interceptor sewers, river
<br />crossings and lift stations, and
<br />=, REAS it is necessary for the location and construction of such river crossings,
<br />lift stations and appurtenances that the easement rights to certain tracts of property
<br />be acquired for the use of such City
<br />NOW, THEREFORE, BE IT RESOLVED that the easement rights be acquired by appropriation
<br />or condemnation, for the use of the City of South Bend, for the location and construction
<br />of sewer river crossings, lift stations and appurtenances, as provided in Chapter 129
<br />of the Indiana Acts of 1905 and. Chapter 61 Acts of 1932 (Special Session) to the several
<br />tracts of property in said City of South Bend, St. Joseph County, State of Indiana,
<br />which may be injuriously or beneficially affected, described as follows, to wit:
<br />TRACT NO. 1
<br />Beginning at a point 5 feet east of the Northwest corner of lot 89 Original Plat
<br />of South Bend, Indiana; thence east along the north line of said lot 89, a distance of
<br />77.50 feet; thence south 15 feet; thence west parallel with and 15 feet South of the
<br />north line of said lot 89 a distance of 37.50 feet; thence south 25 feet; thence west
<br />parallel With and LO feet south of the north line of said lot 89 a distance of LO feet
<br />to the east line of Pill Street; thence north parallel with and 5 feet east of the
<br />west line of said lot 89 (along the east line of i:`ill Street) a distance of LO feet to
<br />the place of beginning. Being part of lot 89 Original Plat of South Bend, Indiana and
<br />part of vacated west race as shown on. recorded plat of South Bend Manufacturing Company
<br />Addition to South Bend.
<br />TRACT No. 2
<br />Beginning at a point 82.50 feet east of the Northwest corner of lot 89 Original
<br />Plat of South Bend, Indiana; thence east 97.50 feet; thence south 15 feet; thence West,
<br />parallel with and 15 feet south of the north line of lot 89 produced east, a distance
<br />of 97.50 feet; thence north 15 feet to the place of beginning. Being part of lot 15
<br />South Bend Manufacturing Company's Addition and part of vacated west race as shown on
<br />recorded plat of South Bend Manufacturing Company's Addition to South Bend.
<br />TRACT NO. 3
<br />1. A parcel of land lying east of the intersection of Edgewater Drive and Monroe
<br />Streets as shown on the recorded plat of Edgewater Place Addition to the City of South
<br />!Bend, bounded by a line running as follows, viz: Beginning at the intersection of the
<br />easterly line of Edgewater Drive and the southerly line of Yonroe Street produced
<br />!easterly, thence easterly on the southerly line of :.�onrce Street produced easterly 21
<br />;feet, more or less, to the low-water mark of the St. Joseph River; thence downstream
<br />along the low-water mark of said river to the northerly line of Monroe Street produced
<br />;easterly; thence Westerly on the northerly line of lJonroe Street produced easterly 23 fee
<br />more or less, -6o the easterly line of Edgewater Drive; thence southerly along the east
<br />line of Edgewater Drive to the place of beginning.

<br />Beginning on the south side of Colfax Avenue at a point 238.68 feet West of the
<br />Northeast corner of lot 11 in Miller and Green's First Addition to the Town of Lowell;
<br />thence West along the North side of said lot 11 a distance of 1);.0 feet; thence South 15
<br />feet; thence East parallel with and 15 feet South of the North line of said lot 11 a
<br />distance of LO feet; thence North 15 feet to the place of beginning, which point is
<br />724.40 feet West of the intersection of the South line of Colfax Avenue and the West
<br />line of Niles Avenue in the City of South Bend, Indiana.
