<br />INDENTURE OF DEED
<br />THIS INDENTURE WITNESSETH, that the CITY OF SOUTH BEND, county of St. Joseph,
<br />State of Indiana, grants, bargains, sells, releases, quit claims 'nd conveys to
<br />SOUTH BEND POST #1167, VETERANS OF FOREIGN WARS, INC., for and in consideration
<br />of the sum of Seven Thousand Dollars ($7,000.00) the receipt whereof is hereby
<br />acknowledged, the following described real estate, in the City of South Bend,
<br />St. Joseph County, State of Indiana, heretofore held by the City of South Bend, for
<br />use of its Park Department, to -wit:
<br />"F-2't and "E-2`t as shown on the recorded Plat of
<br />Lots "G-2",
<br />Wenger and Kriegbaumts Vistula Avenue Addition, more fully
<br />described as beginning on the west edge of the St. Joseph
<br />River on the line between lots "G-2" and 'tH-2" as shown on the
<br />recorded Plat of Wenger and Krieghbaums Vistula Avenue Addition,
<br />thence Southwest on the line between said lots "G-2" and "H-2"

<br />to Lincolnway East, thence Northwest on the Easterly line of
<br />j! Lincolnway East 136.7 feet, thence Northeast parallel to the
<br />a� line between said Lots "G-2" and "H-2"-30 feet; thence North-
<br />west parallel to Lincolnway East 50 feet; thence Northeast

<br />St. Joseph River, thence Southeast along said river, to the
<br />place of beginning.
<br />Subject to the right of the City of South Bend to construct an
<br />interceptor sewer across said land at the approximate location
<br />and depth as shown on the plans for the interceptor sewer in
<br />the Engineerts Office of said City, as provided by the laws of
<br />the State of _ Indiana.
<br />The City of South Bend represents and warrants that it has not
<br />+, made, done, committed or offered any act or acts whereby the
<br />above described real estate, or any part thereof, or the
<br />fee simple title thereto may be impeached, charged or encumbered.
<br />This conveyance is made pursuant to an ordinance of the Common
<br />Council of the City of South Bend, adopted on the 13th day of
<br />August, 1951, and entered in Ordinance Book 9, Page 242 in the
<br />!' Clerkt s Office of the City of South Bend, I?r1 Tana.
