<br />• ij The Board next took note of a copy of the Acting Building Commissionerts
<br />letter, dated April 29, 1954, addressed to Robert L. Huff, Secretary of the Board of
<br />Zoning Appeals, relative to an addition to a building on the premises at 3000 E.
<br />j Washington Avenue, having been constructed without a building permit and in violation
<br />{ of agreement between the property owner and the Board of Zoning Appeals; and in
<br />±� violation of the Building Code. Letter was ordered filed.

<br />A letter, dated May
<br />5, 1954, addressed to the Board from Attorney Russell
<br />C. Kuehl, presenting present status of contracts and insurance requirements of
<br />contractors on the sewage works project, was next read by the Board. The Clerk was
<br />directed to notify Ralph Moorhouse, local representative of Consoer, Townsend and
<br />Associates, of the Boardts approval for pipe deliveries to commence, on the site,
<br />• I! by Independent Pipe Company, and to notify the several contractors to commence work
<br />1 within ten days from this date, contingent upon certain requirements having been
<br />!; met by, or before May 20th.

<br />The Board next examined and approved letter supplied by Paschen Contractors,
<br />Inc., under date of May 6th, over the signature of Jacob Paschen, in which they accept
<br />full responsibility for the pipe after it has been laid down on the site by the
<br />Independent Concrete Pipe Corporation, and inspected by the Cityts representative.
<br />A drawing was next presented to the Board, showing a .canopy construction
<br />proposed for the building at 1117 Mishawaka Avenue, and having found upon examination
<br />that the proposed canopy will present no unsightly or hazardous condition, the Board
<br />proceeded to approve the drawing.
<br />VACATION RESOLUTION NO. 2773
<br />This being the date set, hearing was held on the assessment roll showing the
<br />award of damages and the assessment of benefits in the matter of vacation of Streets,
<br />Alleys, and Utility Easements, all in a part of Edison Park Addition to the City of
<br />South Bend, Indiana, as covered by Vacation Resolution No. 2773, except and excluding
<br />those utility easements covering the north four feet of lots numbered 351 to 359
<br />inclusive, under Vacation Resolution No. 2773.
<br />In the above named assessment roll, no remonstrators appeared and no written
<br />remonstrances were filed, the Clerk of the Board submitted proofs of publication of
<br />notices and samd were found sufficient, and the Board, therefore, finds that the i
<br />several lots and parcels of land have been benefited and damaged in the amounts shown
<br />jj on said roll. The Board, therefore, decided to take final action on said assessment
<br />roll and declares same in all things ratified, confirmed and approved without modificati44'
<br />and the proceedings closed, and the portion of the alleys, streets and utility easements!;
<br />vacated upon receipt of the amount of benefit asses-sments from the various property s'
<br />owners so benefited and all proceedings had with reference to said streets, alleys and
<br />'utility easement vacation are hereby sustained.
<br />TRAFFIC ENGINEER:
<br />!' The recommendations of Traffic Engineer, E. H. Miller, for the protection
<br />jof school children crossing Prairie Avenue at Leon Court, submitted by Engineer Miller,
<br />!under date of May 3, 1954, were considered and approved by the Board. {

<br />iat Dubail Avenue.
<br />The Excavation Bond of James A. Currie, in the sum of $2,000.00, was examined;
<br />and approved.
