<br />The Board next heard the request of John C. Wagner, representing the Mid -States
<br />1' Awning and Furniture Company, for permission to construct a canopy on both the Lafayette "
<br />Boulevard and Sample Street sides of building at 822 S. Lafayette. The Board examined,
<br />drawing submitted by Mr. Wagner and granted the desired permit.

<br />Next appeared before the Board a delegation representing the residents of the'
<br />Southmoor and Beacon Heights veterans housing projects. Mr. Donald Emerick was spokes-
<br />man for the Beacon Heights residents, and Mr. Stephen Tezich was representing Southmoor.
<br />Attorney Seymour Weisberger, representing both groups, known as the Southmoor Heights
<br />Mutual Housing Committee and the Beacon Heights Mutual Housing Committee, addressed the •
<br />! Board, presenting the situation with which these citizens are now confronted. Also, i
<br />present were Robert Reiter, 3723 S. Fellows Street and Robert Hostetler, 206 Jennings
<br />is Street, representing voluntarily resident property owners of area adjoining the South -
<br />moor Heights housing project, and objecting to any concession being made to Southmoor
<br />i' Heights residents, which is not permitted other South Bend citizens. Attorney Weisberger
<br />pointed out the special emergency faced by these residents at this time, who are, in
<br />I the main, World War II veterans and Studebaker and Bendix employees, and it was also
<br />pointed out by both Attorney Weisberger and Mr. Tezich, that the details in which this
<br />i
<br />housing does not presently conform to the building code are of a minor nature. The
<br />j Board was then informed that the present option granted these tenants by the federal
<br />i government expires April 19th, but it is expected an extension of time will be granted,
<br />request for which has already been made. The Board then stated it does not propose to
<br />place any obstacle in the way of these "mutuals" and that in its desire to be of assis-
<br />tance to the present occupants of this housing to acquire ownership, the city will
<br />forego enforcement of building codes for the period of the present option and any ex-
<br />tension thereof granted by the federal government to the present occupants.
<br />Then appeared before the Board, Mrs. S. B. Livingston and Mr. Lee Arnold, request-
<br />ing the fencing of the lagoon in the McKinley Park Addition, stating it had been their
<br />understanding from statement made by the real estate salesman, that the City would fence4
<br />in the lagoon. City Engineer, R. S. Adnrysiak, being present, explained the necessity
<br />for the lagoon for the handling of the storm water from surrounding area, also mentioning
<br />that the lagoon is spring fed as well. He stated that undoubtedly a number of the •
<br />adjoining property owners would object``to the fencing of the lagoon, which both Mrs.
<br />Livingston and Mr. Arnold conceded. The danger to children under five years of age
<br />I' was particularly stressed by Mrs. Livingston. After considerable discussion, ih..which
<br />it was definitely pointed out that the fencing was the responsibility of the individual
<br />property owner, it was agreed by the Board to provide fencing for the four concrete
<br />aprons and for the frontage along Hickory Road, that fencing provided by the property
<br />owners could be placed on land designated as easement, and that the fencing used across
<br />the aprons and the lagoon frontage on Hickory Road would be uniform and of the same
<br />height and manufacture as that decided upon by the property owners involved.
<br />The Boardnext examined a coat left at the office of the Board by Mr. John J. DeGrovb,
<br />of Coloma, Michigan, which was damaged by wet paint on a bus stop sign, on which there •
<br />was no "Wet Paint" warning sign. The Board members were in agreement that Mr. DeGrove
<br />should be indemnified, and decided upon a compromise figure of $15.00 for settlement of
<br />the damage. The Clerk was directed to inform, Mr. DeGrove accordingly.
<br />The Board then took up for review bids opened at the regular meeting of February
<br />8th, for supplying the Stree Department with bituminous material, and accepted the
<br />proposal of the Standard Oil dinpany (Indiana), signing contract forthwith. In the
<br />matter of supplying bituminous coated aggregate, the proposal of Rieth-Riley Constructioh
<br />Co., Inc., for the following specific items, was accepted:

<br />Street Commissioner, H. M. Tomlinson, being present, brought to the BoardIs atten- ''
<br />tion, the completion of the land -fill operations on the property of the Boy Scouts of
<br />America;The City Engineer, R. S. Adnrysiak, being present, advised that an additional I
<br />small area on this property is available for fill -purposes, pointed out to the
<br />commissioner how access to these additional dump sites is to be attained, and directed
<br />that the Sanitation Department proceed with this fill- The Engineer also advised that
<br />he will proceed immediately to investigate two other sites under consideration to be
<br />made available at an early date. The Commissioner was given authorization for main-
<br />taining a Night Dumpmaster to keep the dump site on the Boy Scout property free of night+!
<br />scavengers.
<br />The Board approved the recommendation of E. H. Miller, Traffic Engineer, that park -
<br />be eliminated on the west side of Spruce Street, from Washington Street to the first ally
<br />south, as requested in petition dated February 21, 1954• ii
