<br />VACATION RESOLUTION NO. 2739 1952
<br />This being the date set, hearing was held on the assessment roll showing the award
<br />of damages and the assessment of benefits in the matter of vacation of THE ALLEY RUNNING
<br />NORTH AND SOUTH FROM MISHAWAKA AVENUE TO THE GRAND TRUNK WESTERN RAILROAD RIGHT OF WAY
<br />SITUATED BETWEEN LOTS NUMBERED 713 and 714 WHITCOMB AND KELLERtS THIRD SUNNYMEDE ADDITIO
<br />TO SOUTH BEND under vacation Resolution No. 2739-
<br />• In the above named assessment roll, no remonstrators appeared and no written
<br />remonstrances were filed, the Clerk of the Board submitted proofs of publication of
<br />i notices and same were found sufficient, and the Board, therefore, finds that the several
<br />lots'and parcels of land have been benefited and damaged in the amounts shown on said
<br />roll. The Board, therefore, decided to take final action on said assessment roll and
<br />declares same in all things ratified, confirmed and approved without modification and
<br />the proceedings closed, and the alley vacated upon receipt of the amount of benefit
<br />assessments from the various property owners as benefited and all proceedings had with
<br />reference to said alley vacation are hereby sustained.
<br />Next appeared before the Board, Attorney R. Floyd Searer, and presented a petition
<br />signed by one -hundred eight -seven individuals,protesting against a sign which has recent
<br />• been placed on East Colfax Avenue, declaring "This is not a Street - Private Property",
<br />whereas, the City of South Bend is said to have maintained, graded and graveled this
<br />street, which has been used by the,public and by the residents of this area for a period
<br />in excess of ten years. The petition names the property -owners claiming title to this
<br />street, because of failure on the part of the City of South Bend to obtain formal dedi-
<br />cation of this street for public use, who have acquired title to these premises only
<br />within the past two years. Attorney Searer asked that the Board take action in the
<br />i matter.
<br />The Board directed the Clerk to notify, accordingly, Mr. and Mrs. Jerry Claeys, Jr.
<br />and C. Harry Swanson,Inc., named in the petition as the owners, of the filing of the
<br />petition asking the City to order the removal of the signs posted against public travel
<br />on East Colfax Avenue from ironwood.Drive to 26th Street, and to have said street
<br />declared to be a public street of the City of South Bend by reason of implied dedication.
<br />The Clerk is to further notify said owners to appear before the Board at the office
<br />of the Board of Public Works and Safety in the City Hall, at the Board's regular meeting
<br />10:00 A. M. Monday, December 15th.
<br />i Next appeared before the Board, Wm. A. Hahn, representing the Northern Indiana
<br />Transit, Inc., asking permission of the Board to establish, on a 30-day trial basis,
<br />a new bus line to be known as the McKinley Terrace line. The Board approved the planned
<br />new bus line, which is to be placed in trial operation, commencing Monday, December 1,
<br />1952.
<br />Councilman.Wm. A.: -Hahn, being present, called the attention of the Board, to the
<br />i condition of brick sidewalk on East Colfax Avenue, on the north side of the Street,
<br />immediately east of the property occupied by the South Bend Electric Company, which the
<br />councilman reports to be in urgent need of repair. Mr. Hahn also made complaint con-
<br />cerning the parking of automobiles on the sidewalk in front of the South Bend Electric
<br />Company's store building by employees. The Board referred the sidewalk condition to the
<br />City Engineer for investigation and report, and the illegal parking to Chief of Police,
<br />Richard J. Gillen.

<br />Councilman Hahn again took up with the Board the parking and unloading situation
<br />on Colfax Avenue at the Poledor Building, and was informed by the Board that this
<br />•
<br />problem has had thorough study by the Traffic Department and is in process of being
<br />it solved.
<br />The Board next considered an easement made under date of November 17, 19522
<br />between the firm of Woodland, Inc . , and Place and Company, Inc . , applying to the
<br />northeast corner of the Morris Park Golf Course. The Board approved the easement and"
<br />directed thatit be recorded.
<br />The Board took up the matter of awarding contract for the Tuxedo Drive local
<br />sewer, and the Niles Excavating Company's bid of $17,251.00, being the lowest and 'best
<br />bid, was thereupon accepted by the Board.

<br />RESOLUTION NO. 2734 - 1952
<br />After hearing all persons interested who appeared and the clerk of the Board of
<br />Public Works and Safety having proofs of publication of the notices to property owners
<br />and the same having been found sufficient, therefore,
<br />BE IT RESOLVED, by the Board of Public Works and Safety of the City of South Bend,
<br />Indiana, that the Primary of Preliminary Assessment Roll adopted by the Board on the
<br />loth day of November, 1952, for the improvement of FELLOWS STREET LOCAL SEWER be and
<br />the same is in all things confirmed.
