<br />RESOLUTION NO. 2719
<br />Certificate of Completion was furnished by civil engineer, Wilbur H. Gartner,
<br />accompanied by contractor's completion affidavit of the contract between the.City of
<br />South Bend, Indiana, Owner, and the Rieth-Riley Construction Company, Contractor, for
<br />the construction of the pavement improvement on ALLEY BETWEEN ADAMS STREET AND COLLEGE
<br />STREET from the north line of Humboldt Street to the south line of alley north of Humbold
<br />Street, under Improvement Resolution No. 2719, 1952, has been completed in accordance wit
<br />the plans and specifications for this project.
<br />RESOLUTION ACCEPTING FINAL ESTIMATE
<br />RESOLUTION NO. 2719 - 1952
<br />BE IT RESOLVED, By the Board of Public Works and Safety of the City of South Bend,
<br />Indiana, that the Final Estimate, and Primary Assessment Roll submitted to the Board by
<br />the City Civil Engineer or his duly authorized representative on this 22nd day of
<br />September, 1952 on the improvement known as the ALLEY BETWEEN ADAMS STREET AND COLLEGE
<br />STREET PAVEMENT as described in Improvement Resolution No. 2719 - 1952, passed by the
<br />Board of Public Works and Safety on May 12, 1952, and confirmed by said Board on June 16,
<br />1952, be and the same is hereby adopted, and the Clerk of this Board is hereby requested
<br />to give notice of the hearing of Special Benefits on said Improvement, as required by Sec
<br />tion N.111 or 120 of an Act entitled, "An Act Concerning Municipal Corporations" approved
<br />March 6, 1905.

<br />IMPROVEPENT RESOLUTION RESCINDED NO.2735 - 1952
<br />For the improvement of CHALFANT STREET from the east line of Arthur Street to the
<br />east'.line of Walsh Street by constructing a Class C pavement under improvement Resolution
<br />No. 2735, 1952, adopted August 25, 1952, and first confirmed on September 15, 1952.
<br />A written remonstrance against said improvement bearing the signatures of fifty-one
<br />(51) percent or more of the resident property owners on said street, who may be liable
<br />for assessment for said improvement, having been filed with said Board within the ten day
<br />period following date and time of the hearing on said improvement, therefore
<br />BE IT RESOLVED, by the Board of Public Works and Safety of the City of South Bend,
<br />Indiana, that Improvement Resolution No. 2735, 1952, duly adopted by this Board on August
<br />25, 1952, and first confirmed on September 15, 1952, be and the same is in all things
<br />rescinded and the improvement is hereby ordered not made.

<br />A letter was read by the Board from Ralph E. Allen, Attorney for the Studebaker
<br />Corporation, advising that their representative, Mr. J. P. DeVoir, together with Attorney
<br />Allen, will appear before the Board at their regular meeting on September 29th, in the
<br />matter of dust and noise from the three motorized dust collectors complained of by John
<br />Zrinyi, who registered a complaint with the Board on September 8th.
<br />Mr. Russell Hartman, President of Hartmants Inc. of South Bend, appeared before the
<br />Board and inquired concerning the petition filed with the Board for the extending of the
<br />Lincolnway West bus line to Sheridan,Avenue. A letter from John Martin, Executive
<br />Vice President and General Manager of the Northern Indiana Transit, Inc. was read and the
<br />Board offered the opinion that until the development to be served has increased to the
<br />point where this service is a serious need, the matter should be held in abeyance, and
<br />at this time the Board must deny the facility.
<br />Mr. Hartman also inquired concerning a petition for improved lighting at North
<br />Chicago Street between Lincolnway West and Bulla Street, and was informed that favorable
<br />action is forthcoming in this matter, in its proper sequence.
