• <br />C <br />0 <br />0 <br />A letter was received from the City Plan Commission indicating that they recommend <br />the vacation of West Colfax Avenue from Brookfield Street to Johnson Street and the Engi: <br />eering Department was directed to prepare a vacation Resolution. <br />VACATION RESOLUTION NO. 2696, 1951 <br />RESOLVED BY THE BOARD OF PUBLIC VO RKS OF THE CITY OF SOUTH BEND, INDIANA: That it is <br />desirable to vacate the following; <br />A PORTION OF COLUMBIA STREET DESCRIBED AS FOLLOWS: Commencing at a point ian the <br />west line of Columbia Street at a point 134 feet northeasterly at right angles <br />from the northeasterly line of Lincoln Way East; thence southeasterly across <br />Columbia Street on a line projected southeasterly to the east line of said <br />Columbia Street and which line before projection southeasterly is 134 feet <br />northeasterly at right angles and parallel to the northeasterly line of Lincoln <br />Way East; thence north along the east line of Columbia Street to the river's edge; <br />thence northwesterly along the riverts edge to the west line of Columbia Street; <br />thence south along west line of Columbia Street to place of Beginning; said va- <br />cation being subject to all easements now existing and inuring to the benefit <br />of public utilities operating in the City of South Bend. <br />The following property may be injuriously or beneficially effected by such vacation: <br />Lots numbered 77 and 109, part of Original Plat of South Bend. <br />Notice of this resolution shall be published on the 14th day of December and on the <br />21st day of December, 1951, in the South Bend Daily Tribune and the Weekly Record. <br />This Board, at its office in the City Hall on the 31st day of December, 1951, at <br />11;00 a.m., will hear and receive remonstrances from all persons interested in or affect <br />ed by these proceedings. <br />Adopted this loth day of December, 1951, <br />R. Baer <br />BOARD OF PUBLIC VU RKS & SAFETY <br />VACATION RESOLUTION NO. 2692, 1951 <br />This being the date set, continued hearing was held on the Assessement Roll showing <br />the award of damages and the assessment of benefits in the matter of the vacation of. the <br />FIRST ALLEY WEST OF EDDY STREET from Washington Street north to the south line of the <br />alley running east and west under Vacation Resolution No. 2692. <br />Present at the hearing were Irving Smith, Attorney for the petitioner, and Leo P. <br />Rieder, Attorney for the remonstrator. The Clerk of the Board submitted proofs of pub- <br />lication of notices and same were found sufficient. The Board being;_fully advised in <br />the premises denies the remonstrance and finds that the several lots and parcels of land <br />shown on the Assessment Roll have been benefited and damaged in the amounts shown on <br />said roll. The Board, therefore, decides to take final action on said Assessment Roll <br />and declares same in all things ratified, confirmed and approved without modification <br />and the proceedings closed and the alley vacated upon receipt of the amount of benefit <br />assessment from the various property owners so benefited and all proceedings had with re <br />ference to said alley vacation are hereby sustained. <br />VACATION RESOLUTION N0. 2694, 1951 <br />This being the date set for continued hearing on the resolution hereto adopted by <br />the Board of Public Works and Safety for the vacation of the alley running north and Bout, <br />from Western Avenue to Monroe Street between 'Columbia and Carroll Streets under Vacation I <br />Resolution No. 2694,, hearing was held. The Clerk of the Board having showed proofs of <br />publication of notices and same were found sufficient. Irving J. Smith, Attorney, appear <br />ed for the petitioners. The National Storage, Warehouse Company, Inc., owners of Lot #13 +� <br />and 33 feet over the entire north side of Lot #14 in the recorded plat of Denniston and i! <br />Fellows Addition, appeared, represented by F._ J. Nimtz of DuComb & DuComb and remonstrated <br />vacating the alley immediately east of their -land, but stated that they would have no <br />objection to vacating the rest of the alley. The Indiana & Michigan Electric..Company ap 1 <br />peered by Warren E. McGill of Seebirt Oare and Deahl and stated that they had no objection <br />to the vacation of the alley and that no utility lines would be interfered with by reaso <br />of said vacation. The Board now finds that said alley should be vacated, excepting the <br />north 99 feet of said alley, being that portion of the alley lying to the east of Lot13 <br />and,to the north half of Lot #14 in said addition. It is now ordered that said alley <br />running north and south from Western Avenue to Monroe Street between Columbia Street <br />and Carroll Street be vacated except the north 99 fe6t of said alley 1_ying immediately :3 <br />east of Lot #13 and the north half of Lot #14 and west of Lot #12 and west of the north <br />half of Lot#ll. The Engineering Department is directed to prepare an assessment roll <br />covering the assessment of benefits and the award of damages to the surrounding properties. <br />
