VACATION RESOLUTION NO. 2692 <br />This being the date set, hearing was had on the assessment roll showing the award <br />of damages and the assessment of benefits in the matter of the vacation of the first <br />alley tlest of Eddy Street from Washington Street North to the South line of the alley <br />running east and Wiest, under Vacation Resolution No. 2692. <br />Comes now, Mr. Leo P. Reider, and files the following remonstrance: <br />I� REMONSTRANCE AGAINST AMOUNT OF DAMAGES <br />ASSESSED UNDER VACATION RESOLUTION 2692 <br />City of South Bend Indiana <br />November 27, 1951 <br />TO THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF SOUTH BEND: <br />a <br />j The undersigned respectfully shows that she is the owner of the following described <br />real estate located in the City of South Bend, State of Indiana <br />. j a part of Large Lot numbered 16 as shown on the recorded plat of Samuel L. Cottrell <br />First Addition to the Town of Lowell, now a part of the City of South Bend, Indiana, whi <br />part is bounded by a line running as .follows, viz: Beginning on the South line of said <br />Large Lot numbered 16 at a point 229 feet east of the southwest corner of said Lot;, <br />thence running east on the south line thereof 53.1 feet; thence north 198 feet to a publ <br />3 alley running east and west through the center of said Large Lot numbered 16; thence wes <br />I vath the south line of said public alley 53.1 feet more or less to the eust line of a <br />j public alley running north from T'ashington Street; thence south along the east line of <br />said public alley 198 feet to place of beginning. _ <br />• <br />• <br />• <br />0 <br />That said parcel of land lies immediately east and borders on the east the alley <br />which is proposed to be vacated under Vacation Resolution No. 2692 now pending before <br />this Board. <br />the <br />That byvacating of said alley the undersigned's property, as herein described will <br />be injured and damaged in tralue of not less than Two Thousand Dollars ($2,000.00) wherea <br />she has been awarded no dollars by this Board. <br />The undersigned respectfully remonstrances against the failure of this Board to <br />award to her in the sum of not less than Two Thousand Dollars ($2,000.00). <br />U-!HEREFOREY she claims as damages the sum of not less than Two Thousand Dollars <br />($21, 000.00 ). <br />(s) Florence Vaughn Carroll <br />Also appearing before the Board were Wallace Schwalm, petitioner and his Attorney <br />Irving Smith. The hearing was continued until Monday, December 10, 1951 at 11:00 A.M. <br />VACATION RESOLUTION NO. 2693 <br />This being the date set, hearing was had on the assessment roll showingthe award of <br />damages and the assessment of benefits in the matter of the vacation of the first alley <br />South of California Avenue f roan Wilbur Street to the East line of the North and South <br />Alley and from the IA,Test line of .the North and South alley to Adams Street under Vacation <br />Resolution No. 2693. <br />In the above named assessment roll, no remonstrators appeared and no written remon- <br />strances were filed. The Clerk of the Board submitted proofs of publication of notices <br />and same were found suffucient, and the Board, therefore, finds that the several lots <br />and parcels of land have been benefitted and damaged in the amounts shown on said roll. <br />The Board, therefore, decides to take final [action on said assessment roll and declares <br />same in all things ratified, confirrre d and approved without modification, a nd the pro- <br />ceedinrts closed, and the alley vacated upon receipt of the amount of benefit assessments <br />from the various property owners so benefitted and all proceedings had with reference <br />to said alley vacation are hereby sustained. <br />VACATION RESOLUTION 2694 <br />This being 'the date set for hearing on the Resolution heretofore adopted by the <br />Board of Public Works for the vacation of the alley running north and south from Western <br />Avenue to Monroe Street between Columbia Street and Carroll Street under Vacation Resol- <br />ution No. 2694, hearing was had. <br />Comes now, Irving J. Smith, Attorney for the Petitioner, who files a request for a <br />continuence on the hearing until Monday, December loth, 1951 at 11 00 A.M. The Board <br />granted the request for continuance. <br />
