VACATION RESOLUTION no. 2695 <br />This being the date set, hearing was had on the resolution heretofore adopted by th <br />Board of Public Works for the vacation of the alley South of Monroe Street from Main <br />Street West to the East line of the North and South Alley running from Monroe Street to <br />South Street, under Vacation Resolution No. 2695. The Clerk of the Board having shown <br />sufficient proofs of publication and no remonstrators having appeared and no written <br />remonstrances having been filed with the Clerk, it was moved, seconded and unanimously <br />carried that the said resolution be finally adopted and the said alley be vacated. The <br />Engineering Department is directed to prepare an assessment roll showing the assessment <br />of benefits and the award of damages to the surrounding properties.. <br />R. S. Andrysia}X, City Engineer, filed primary assessment roll showing the awards <br />of damages and the assessment of benefits in the matter of the vacation of the alley Sou <br />of Monroe Street from Main Street lvvest to the East.line of the North and South alley <br />running from Monroe Street to South Street, under Vacation Resolution No. 2695. <br />In the above named assessment roll, the Board hereby orders that it will meet in th <br />City Hall at 11t00 A.M. on the 17th day of December, 1951 for the purpose of hearing and <br />receiving remonstrances from all persons interested in or affected by said vacation, and <br />the Board further orders thatnotice of said hearing, together with the amount of damages <br />awarded and benefits assessed be addressed to the property owners by publishing same on <br />the 7th day of December and on the 14th day of December, 1951 in the South Bend Tribune <br />and the Tri-County News. <br />WHEREAS, the Crown Development Company, Inc., is causing to be constructed at its <br />own expense what is known as the McKinley Pumping Station located between the curb line <br />and the South property line of Corby Street at the Northwest corner of Lot Numbered <br />Two Hundred Eighty-nine (289) as shown on the recorded Plat of McKinley Terrace Addition <br />for the purpose of providing aewage service for residents in that immediate area; and <br />WHEREAS, the plans, specifications and requirements for said pumping station have <br />submitted to and approved by the South Bend City Engineer, <br />NOW, THEREFORE, BE IT RESOLVED <br />That upon the completion of the aforesaid pumping Station at the sole expense of th <br />Crown Development Company, Inc. in accordance with the plans, specifications and require <br />ments heretofore submitted to and approved by the South Bend City Engineer, The City of <br />South Bend, Indiana shall assume the operation and maintenance of said pumping station. <br />This resolution adopted this 3rd day of December, 1951. <br />(s) R. Reed who being <br />duly sworn upon oath deposes and says he is acquainted with the Reed Construction Compan <br />Mishawaka, Indiana, the party to whom was awarded the contract and who performed the wor <br />under Improvement Resolution No. 2679-1951, VI'ELLINGTON STREET PAVEMENT'. <br />That he is familiar with and personally knows the requirements of the plans and <br />specifications of said improvement resolution and further knows that -the said REED CONS: <br />STRUCTION COMPANY in the performance of said work complied with all the terms and con- <br />ditions of said plans and specifications in every p articul, and that the material used <br />was of the character, kind, quantity and quality required therein and according to and <br />under the direction of the Board of Wublic Works and Safety. <br />(s) Virgil H.
