336 <br />A letter was received from the Rieth-Riley Construction Company indicating that the <br />will furnish all material, labor and equipment necessary to remove old sidewalk and con- <br />struct new sidewalk at a price of:fifty-seven cents (5W per square foot. This was <br />placed on file. <br />The Board waived the set -back lines on Eddy Street on the east side of the street at <br />928 North Eddy Street for the construction of an addition to an existing building contin- <br />gent upon the condition thatt he owner and builder of this addition will waive any damage <br />done to the said building if and when the widening of Eddy Street takes place. <br />VACATION RESOLUTION NO. 2680 • <br />September 4, 1951, being the date set, hearing was held -on that date on the assessme t <br />roll showing the award of damages and the assessment of benefits in the matter of vacatio <br />ll <br />of THE ALLEY WEST OF MAIN STREET from the south line of Donald Street to Ewing Avenue <br />under Vacation Resolution No. 2680. <br />In the above named assessment roll, no remonstrators appeared and no written remon- <br />strances were filed, the Clerk of the Board submitted proofs of publication of notices a <br />game were found sufficient, and the Board, therefore, finds that t he several.lots and <br />parcels of land have been benefited and damaged in the amounts shown on s aid roll. The Clerk of the Board having shown sufficient proofs of publicatio <br />and' no remonstrators having appeared and no written remonstrances having been filed with <br />the°Clerk, it was moved, seconded and unanimously carried that the said resolution be <br />finally adopted and the said alley be vacated. The Engineering Department is directed <br />to prepare an assessment roll covering the assessment of benefits and the award of damage <br />to the surrounding properties. <br />NOTICE OF HEARING SPECIAL BENEFITS ON STREET IMPROVEMENT <br />South Bend, Indiana <br />September 14, 1951 <br />September 21, 1951 <br />Notice is hereby given, that the following Street Improvement has been completed. The <br />generalc haracter of the improvement, the street, a lley or public place on which it has <br />been made, and the terminal points thereof, are as follows: WILBER STREET PAVEMENT from <br />the north line of Fassnacht Avenue to the southerly line of LaPorte Avenue. <br />There is on file in the office of the City Controller of said City an assessment rol <br />with the names of the owners and description of property subject to be assessed with the <br />amount of the prima facia assessment, and can be seen in the office of said City Control- <br />ler. <br />The Board of Public Works and Safety of said City, at the office of the Board in <br />said City, will on the lst day of October, 1951, at 10:00 61clock AM -CST receive and hea <br />remonstrances against the amounts assessed against their property respectively, on said <br />roll and will determine the question as to whether such lots, or tracts of land, have <br />been or will be benefited by said improvement to the amounts named on said roll, or is <br />greater or less than that named on said roll or in any sum.
