336 A letter was received from the Rieth-Riley Construction Company indicating that the will furnish all material, labor and equipment necessary to remove old sidewalk and con- struct new sidewalk at a price of:fifty-seven cents (5W per square foot. This was placed on file. The Board waived the set -back lines on Eddy Street on the east side of the street at 928 North Eddy Street for the construction of an addition to an existing building contin- gent upon the condition thatt he owner and builder of this addition will waive any damage done to the said building if and when the widening of Eddy Street takes place. VACATION RESOLUTION NO. 2680 • September 4, 1951, being the date set, hearing was held -on that date on the assessme t roll showing the award of damages and the assessment of benefits in the matter of vacatio ll of THE ALLEY WEST OF MAIN STREET from the south line of Donald Street to Ewing Avenue under Vacation Resolution No. 2680. In the above named assessment roll, no remonstrators appeared and no written remon- strances were filed, the Clerk of the Board submitted proofs of publication of notices a game were found sufficient, and the Board, therefore, finds that t he several.lots and parcels of land have been benefited and damaged in the amounts shown on s aid roll. The Board, therefore, decided to take final action on said assessment roll and declares same in all things ratified, confirmed and approved without modefication and the proceedings closed, and the alley vacated upon receipt of the amount of benefit assessments from the various property owners so benefited and all proceedings had with reference to said alle vacation are hereby sustained. VACATION RESOLUTION NO. 2686 This being the date set, hearing was had on "the resolution heretofore adopted by the'Board of Public Works for the vacation of the FIRST ALLEY WEST OF SCOTT STREET from Lincoln Way West to the south line of the alley north of Lincoln Way West under Vacation Resolution No. 2686. The Clerk of the Board having shown sufficient proofs of publicatio and' no remonstrators having appeared and no written remonstrances having been filed with the°Clerk, it was moved, seconded and unanimously carried that the said resolution be finally adopted and the said alley be vacated. The Engineering Department is directed to prepare an assessment roll covering the assessment of benefits and the award of damage to the surrounding properties. NOTICE OF HEARING SPECIAL BENEFITS ON STREET IMPROVEMENT South Bend, Indiana September 14, 1951 September 21, 1951 Notice is hereby given, that the following Street Improvement has been completed. The generalc haracter of the improvement, the street, a lley or public place on which it has been made, and the terminal points thereof, are as follows: WILBER STREET PAVEMENT from the north line of Fassnacht Avenue to the southerly line of LaPorte Avenue. There is on file in the office of the City Controller of said City an assessment rol with the names of the owners and description of property subject to be assessed with the amount of the prima facia assessment, and can be seen in the office of said City Control- ler. The Board of Public Works and Safety of said City, at the office of the Board in said City, will on the lst day of October, 1951, at 10:00 61clock AM -CST receive and hea remonstrances against the amounts assessed against their property respectively, on said roll and will determine the question as to whether such lots, or tracts of land, have been or will be benefited by said improvement to the amounts named on said roll, or is greater or less than that named on said roll or in any sum.
