275 <br />DEDICATION <br />WHEREAS, a plat with dedication of streets and alleys indicated thereon is now pre- <br />,sented to the Board to be known as Hartmants Twyckenham Plat an addition to South Bend, <br />Indiana, and <br />This plat and dedication is filed in the records of the Board of Public Works and <br />Safety in Row #, Drawer # , and recorded in Book # 18 , Page "H" , in the Recorder's <br />Office of St. Joseph County, <br />NOW, THEREFORE, be it resolved by the Board of Public Works and Safety of the City <br />of South Bend, Indiana, that all public streets, alleys and public places dedicated to t: <br />public use in said plat are hereby accepted and approved by said Board for and on behalf <br />iof the City of South Bend, Indiana. <br />VACATION RESOLUTION NO.. 2671 <br />This being the date set, hearing was held on the assessment roll showing the award <br />�of damages and the assessment of benefits in the matter of vacation of THAT PART OF EAST <br />iMATION STREET BOUNDED AS FOLLOWS: Beginning at a point 201 feet east of the north-west <br />jcorner of Lot 130 in the original Plat of South Bend; thence north 15 feet; thence east <br />parallel to the south line of Marion Street to the writ line of the St. Joseph River; <br />thence southwesterly along the west line of the St. Joseph River to the south line of <br />Marion Street; thence west on the south line of Marion Street 343.28 feet more or less <br />to the place of beginning, said 15 foot strip of East Marion Street being that part of <br />said street lying north of the north property line of Lot 118 in the Original Plat... of <br />;South Bend and a part of vacated St. Joseph Street immediately west thereof, under Vaca- <br />tion Resolution No. 2671. <br />Now In the above named assessment roll, no remonstrators appeared and no written remon- <br />strances were filed., the Clerk of the Board submitted proofs of publication of notices <br />and same were found sufficient, and the Board, therefore, finds that the several lots and <br />• parcels of land have been benefited and damaged in the amounts shown on said roll. The <br />Board, therefore, decided to take final action on said assessment roll and declares same <br />In all things ratified, confirmed and approved without modification and the proceedings <br />.closed, and the part of street vacated upon receipt of the amount of benefit assessments <br />1jfrom the various property owners so benefited and all proceedings had with reference to <br />jsaid street vacation are hereby sustained. <br />L. C. Chapleau, Attorney, Mr. Leffler, Plant Manager, and Mr. Redrick, Superintenden <br />of Maintenance, representing the Oliver Corporation, and Mr. Joseph;S6bezyk, and,Mr. <br />ILemanski representing the property owners in the vicinity of the Oliver Plant appeared <br />;before the Board to discuss the complaints lodged agtinst the Oliver Corporation. Mr. <br />;Leffler informed the Board that the whistle the people had objected to, had been moved to <br />• la point further away from the street and that the drop -hammers have ceased operating at <br />110 o'clock each night excepting for the use of one hammer. Mr. Leffler further stated <br />that he would investigate the operation of the drop -hammer to see if it is being properly <br />;operated to further cut down the noise. He, also, stated that they were willing to co- <br />operate in any way so as to satisfy the surrounding property owners, but could not pro- <br />jmiseto cease using the drop -hammers at night altogether, as in the event of a rush order, <br />'they would have to work three shifts.
