<br />Be It Resolved, By the Board of Public Works and Safety of the City of South Bend,
<br />Indiana, that it is deemed necessary to improve WILBER STREET from the north line of
<br />Fassnacht Avenue to the southerly line of LaPorte Avenue, AND

<br />KENMORE STREET from the north line of Western Avenue to the south line of Linden Avenue,
<br />AND
<br />WELLINGTON STREET from the north line of Western Avenue to the south line of Linden Ave-
<br />nue by constructing Class "C" pavements.
<br />The same to be done in accordance with the profiles, drawings, plans, general detail
<br />and specifications of such improvements approved May 7, 1951, and to be adopted by the
<br />Board of Public Works and Safety of the City of South Bend, immediately upon the final
<br />adoption of these resolutions, and placed on file in the office of the City Civil Engine
<br />of Said City, and such improvements are now ordered.
<br />The total cost of said improvements, including all incidental costs such as advertis
<br />ing, abstracting, inspection and engineering, shall be assessed upon the real estate
<br />abutting on said WILBER STREET, KENMORE STREET, and ',��LLINGTON STREET to be improved, al
<br />according to the method and manner provided for in an Act of the General Assembly of the
<br />State of Indiana, entitled, "An Act Concerning Municipal Corporations" approved March 6,
<br />1905, and in accordance with and pursuant to the provisions of all amendatory and supple
<br />mental acts thereto, passed by the General Assembly of the State of Indiana. Assessment
<br />if deferred, are to be paid in ten equal installments; with interest at the rate of six
<br />(6) per cent per annum. (A bond or bonds shall be issued to the contractor in payment
<br />of assessments, as the several owners of real estate upon which they are a lien exercise
<br />the right to pay the same in ten equal installments.) Under no circumstances shall the
<br />City of South Bend, Indiana, be or be held responsible for any sum or sums due from said
<br />property owner or owners for said work, or for certificate or certificates, bond or bond
<br />issued to said contractor in payment for such,work, except for such moneys as shall have
<br />been actually received by the City from assessments for such improvement, or such moneys
<br />as the City is by said entitled Act and the provisions of all Acts amendatory and suuple
<br />mental thereto, required to pay. All proceedings had and work done in making of -said
<br />improvements, assessment.of property, collection of assessments and issuance of bonds
<br />therefor, shall be as provided for in said entitled Act and amdndments thereto.
<br />-The 31st day of May, 1951, at the hour of 6:30 o.?clock P.M. -CST is hereby fixed as
<br />the. time, and the office of the Board in said City as the place, when and where all per-
<br />sons whose property may be affect4d by such proposed improvements,,may be heard as to th
<br />necessity for the same, and all petitions and remonstrances received and the Board will,
<br />on said day, decide.'whether the benefits accruing to abutting and adjacent property, and
<br />to the City of South Bend, Indiana, will be equal to or exceed -the estimated cost of sai
<br />improvements. The Clerk of the Board is hereby ordered to give notice by two weekly pub
<br />lications, of the time and place of hearing of these resolutions.
