<br />The Petition of Willi -am Duncan and twenty-three (23) others for the construction of
<br />a local sewer on LIBERTY STREET from 190 feet south of the south line of Washington St.,
<br />to 164 feet north of the north line of Western Avenue having been received by the Board
<br />and referred to the City Engineer for investigation and. recoT.1,mendation, the City Civil
<br />Engineer now reco::mends that said petition be granted. Wilbur H. Gartner and Associates
<br />were directed to prepare general details, drawings, plans, specifications, estimates and
<br />preliminary improvement -resolution for improving such part of said street by tine cons tru

<br />Be It Resolved, By the Board of Public ��lor4�s and Safety of the City of South Bend,
<br />'Indiana that it is deemed necessary to improve LIBERTY STREET from 190 feet south of the
<br />south line of Washington Street to 164 feet north of the north line of Western .Avenue by
<br />• the construction of a local sewer, intended and adapted only for local use by the propert
<br />holders whose propertyabuts thereon and not intended or adapted for receiving sewage fro
<br />collateral drains, Said sewer to be 12 inc:1es in diameter, and said sewer, with all its
<br />appurtenances, shall be constructed in accordance wit; the profiles, drawings,Jplans,
<br />general details and specifications of such improvement approved January23, 1950, and to.
<br />be adopted by the Board of Public Works and Safety of the City of South Bend, irlrrtediately
<br />upon the final adoption of this resolution, and placed on file in,the office of the Board
<br />of Pifbl i c Works and Safety of said City, and such ir:,proverr_ent is now ordered.
<br />The total cost of said L rovement, including- all incidental costs such as advertis-
<br />ing, abstracting, inspection and engineering, shall be assessed upon the real estate abut
<br />ting on said LIBERTY STREET to be iruproved, all according to the method and manner provid
<br />• for in an .Act of the General Assembly of the State of Indiana, entitled, ".An Act Concern-
<br />ing 1-funicipal Corporations" approved '!.`arch 6th, 190,1, and in accordance with and pursuant
<br />to the provisions of all amenaatorr and supplemental acts thereto, passed by the General
<br />Assemble of the State of Indiana. Assessments, if deferred, are to be paid in ten equal
<br />installments, frith interest at the rate of six (6) per cent per annurr. (.c'= bond or bonds
<br />shall be issued -to the contractor in pain-ent of assessments, as t le several owners of rea

<br />sponsible for any sum or sums due from said property owner or oi.rners for said work, or
<br />for the collection of the same, or for t12e pa �-,acnt of any certificate or certificates,
<br />b,)nd or bonds, issued to said contractor in pa.-,., ent for such work, except for such moneys
<br />as shall have been actually received by tle City from assessments for such improvement,
<br />• for such moneys as the City is by said entitled Act and the provisions of all Acts amenda-
<br />tory and supplemental thereto, reauired to pay. All proceedings had and work done in mak
<br />ing of said improvement, assessment of property, collection of assessments and issuance
<br />of bonds therefor, shall be as provided for in said entitled Act and amendments thereto.

<br />The 16th day of February, 1950 at the hour of 7:30 PM -CST is hereby fixed as the
<br />time, and the office of the Board in said City as the place, when and where all persons
<br />,whoseliroperty may be affected by such proposed improvement, may be hears, and all petitions
<br />f and re_m__onstrances received and the Board will, on said day, decide wheth r the benefits
<br />accruing to abutting and adjacent property, and to the City of South Lend, Indiana will
<br />f be equal to or exceed the estimated cost of said improvernnent. .And the Clerk of the Board;
