<br />IMPROVEMENT RESOLUTION NO. 261E-1 1950

<br />Be It Resolved, By the Board of Public Works and Safety of the City of South Bend,
<br />Indiana, that it is deemed necessary to improve FISHER STREET from the center line of
<br />Olive Street to 167 feet east of the east line of i11eade Street by the construction of a
<br />local serer, intended and adapted only for local use by the property holders whose pro-
<br />perty abuts thereon and not intended or adapted for receiving sewage from. collateral dra.
<br />Said sewer to be 12 inches in diameter, and said..sewer, with all its appurtenances, shal
<br />be constructed in accordance with the profiles, drawings, plans, general details and spe
<br />cifications of such improvement approved January .23, 1970 and to be ,adopted by the Board
<br />of Public Works and Safetjr of the City of South Bend, immediately upon the final adoptia
<br />of this resolution, and placed on file in the office of the Board of Public Works and Sa.
<br />of said City, and such improvement is now ordered.
<br />The total cost of said improvement, including all incidental costs such as a.dvertis
<br />ing, abstracting, inspection and engineering, shall be assessed upon the real estate
<br />abutting on said FISHER STREET to be improved; a.11 according to the method and manner
<br />provided for in an Act of the General Assembly of 'he State of Indiana., entitled, "An Ac
<br />Concerning M-anicipa.l Corporations" approved March 6th, 1905, and in accordance with and
<br />pursuant to the provisions of all amendator and supplemental acts thereto, passed by
<br />the General Assembly of the State of Indiana, Assessrients, if deferred, are to be paid
<br />in ten equal installments, With interest at the rate of six (6) per cent per annum. (A
<br />bond or bonds shall be issued to the contractor in pa.yr_:ent of assessments, as the severa
<br />owners of real estate upon which the;T are a lien exercise ti.e right to pay the same in
<br />ten equal installments.) Under no circu_rris - ances shall the City of South Bend, Indiana. b
<br />or be held responsible for any sum or sums due from said property owner or owners for
<br />said work, or for the collection of the sure, or for t'_e pay-ment of any certificate or
<br />certificates, bond or bonds, issued to said coitra.ctor in payment for.such work, except
<br />for such moneys as shall have been actually received by the City from assessments for su
<br />improvement, or such moneys as the City is by said entitled Act and the provisions of a.l
<br />Acts amendatory and supplemental thereto, required to pay. All proceedings had and work
<br />done in making of said improvement, assessment of property, collection of assessments an
<br />issuance of bonds therefor, shall be as provided for in said entitled Act and amendments
<br />thereto.
<br />The 15th day of F�'ebru=7,r, 1950 at the hour of 7:30 PI•` -CST is hereby fixed as the
<br />time, and the office of the Begird . in sui d Cit�r a s the place, when and where all persons
<br />w hose property may be affected by such proposed 4mprove7ent, _r ay be heard, and all, peti-
<br />tions and remonstrances received and the Board will, on said day, decide whether the
<br />benefits accruing to abutting and adjacent property, and to the City of South Bend, indi
<br />will be equal to or exceed the estimated cost of said improvement. And the Clerk of the
<br />Board is hereby ordered to give notice by two weekly pu-lications, of the time and place
<br />of hearing of this resolution.

<br />Street having been received by the Board and referred to the City Engineer for investiga
<br />Lion and recommendation, the City Civil Engineer -nowreco :ends that said petition be
<br />granted, Wilbur H. Gartner and Associates were directed to prepare general details, dra'
<br />ings, plans, specifications, estimates and preliminary- improvement resolution for improv
<br />ing such part of said street b-,T the construction of a local serer. Comes now Wilbur H.
<br />Gartner and .Associates who report said profiles, drawings, plans, general details, speci
<br />fi cations, estimates and preliminary improvement resolution for the improvement of CALVE:
<br />STREET from the center line of Olive Street to the center Lire of Kaley Street by the
<br />construction of a. local sewer,

<br />Olive Street to the center line of Kaley Street by the construction of a. local sewer,
<br />intended and ,adapted on!-,,, for local use by the property holders whose property abuts the
<br />on and :not intended or adapted for receiving sewage from collateral drains, Said sewer
<br />to be 12 and 15 inches in diameter; and said sewer, with all its appurtenances, shall be
<br />constructed in accordance witi the profiles, drawings, plans, general details and specif
<br />cations of such improvement approved January, 23, 1950 and to be adopted by the Board of
<br />Public Works and Safety of the City of South Bend, upon the final adoption
<br />of this resolution, and placed on file in the office of the Board of Public Works and Sa
