<br />The 16,th day of February, 1950 at the hour of 7:30 PM -CST, is hereby fixed as the

<br />A Verbal Request for the construction of a. local sewer on CHALFANT STREET from 178
<br />feet west of the west line of Jacob St., to 75 feet west of the west line of Twyckenham
<br />Drive having been received by the Board and referred to the City Engineer for investiga-
<br />tion and recommendation, the City Civil Engineer now recommends that said petition be
<br />granted. Wilbur H. Gartner and Associates were directed.to prepare general details, dra-
<br />ings, plans, specifications, estimates and preliminary improvement resolution for improv
<br />ing such part of said street by the construction of a. local sewer. Comes now Wilbur H.
<br />Ga'.rtner and Associates who report said profiles, drawings, plans, general details, speci
<br />fication, estimates and preliminary improvement resolution for the improvement of CHALFA
<br />STREET from 178 feet west of the west line of Jacob Street to 75 feet west of the west
<br />line of Twyckenham Drive, by the con-struction of a local sewer.

<br />Be It Resolved, By the Board of Public Works and Sefety of the City of South Bend,
<br />Indiana, that it is deemed necessary to improve CULFANT STREET from 178 feet west of th
<br />west line of Jacob Street to 75 feet west of the west line of TTYryckenham Drive by the
<br />construction of a local sewer, intended and adapted only for local use by the property
<br />holders whose property abuts thereon and not intended or adapted for receiving sewage fr
<br />collateral drains, Said sewer to be 12 and 15 incises in diameter, and said sewer, with.
<br />all its appurtenances, shall be constructed in accordance with the profiles, drawings',
<br />plans, general details and specifications of such improvement approved January 23, 19507
<br />and to be adopted by the Board of Public 'ores and Safety of the City of Soutn Bend, im-
<br />mediately ypon the final adoption of this resolution, and placed on file in the -office
<br />of the Board of Public Works and Safety or said Ci t;r, and such improvement is now ordere
<br />° The total cost of said improvement, including all incidental costs such as adverti
<br />ing, abstracting, inspection and engineering, shall be assessed upon the real estate abu
<br />Ling on said C ALFANT STREET to be improved, all according to the method and manner prov
<br />for in an Act of the General Assembly of the State of Indiana, entitled, "An Act Concern
<br />Municipal Corporations" approved Parch 6th, 1905, and in accordance w_t!-i an pursuant to
<br />the provisions of all amendatory and supplemental acts thereto, passed by the General
<br />Assembly of the State of Indiana. Assessments, if deferred, are to be paid in ten equal
<br />installments, with interest at the rate of six (6) per cent per annum. (A bond or bonds
<br />shall be issued to the contractor in pay -lent of assessments, as the several owners of re
<br />estate upon which they are a lien exercise the right to pay the same in ten equal instal
<br />lments.) Under no circuinstances shall t .e City of South Bend, Indiana be or be held re-
<br />sponsible for any sure or sums due from said property owner or owners for said work, or f
<br />the collection of the same, or for the payment of any certificate or certificates., bond
<br />or bonds, issued to said contractor in payment for such work, except for such moneys as
<br />shall have been actually received by the City from assessments for suc)_ improvement, or
<br />such moneys as the City is by said entitled Act and 'Ghe provisions of all Acts amendator
<br />a..nd supplemental thereto, required to pay. All p_roceed-i ngs had and work done in making;
<br />of said improvement, assessment of property, collection of assessment and issuance of bo
<br />therefor, shall be as provided for in said entitled Act and amend__�ents thereto.
