<br />The Board approved sewer plans for a local sewer on Sheridan .Avenue from the first
<br />alley north of Western Avenue north to Washington Street for the Colpaert Realty Company.
<br />A verbal request for the construction of a local sewer on Corby Street, Campau Street,
<br />and Twyckenham Drive having been -received by the Board and referred to the City Engineer
<br />for investigation and recommendation, the City Civil Engineer now reco_n__ends that said
<br />petition_ be granted. Wilbur H. Gartner and Associates were directed to prepare general
<br />details, drawings, plans, specifications, estimates and preliriinary improvement resolutioll
<br />for improving such part of said street by the construction of a local sewer. Comes now
<br />Wilbur H. Gartner and associates -•dho report said profiles, drawings, plans, general detai�.s,
<br />specification, estimates and preliminary improvement resolution for the improvement of
<br />d T��r�rc'_�eniiar Drive by the construction of a local setrer.

<br />T_ndiana that it is deemed necessary to improve CORBY STREET from the center line of
<br />Jacob Street to the center line of i'c:ryc Tenham _)__L CAMPAU STREET ET from 155 feet west of
<br />the west line of Jacob Street to the center line of�Twyckenham Drive? nTY'CKEEN1-1AT DRIVE
<br />from the center line of Corby Street to feet north of the north line of Soria Street
<br />'by the construction of a. local scwcr, intended and adapted only for local use by the pro-
<br />perty holders whose property abuts thereon and not intended or adapted for. receiving sew-
<br />age from collateral drains, Said sewer to be 12"-15"-18" in diameter, and said sewer, wit
<br />'all its-a.ppurtenances, shall be constructed in accordance with the profiles, drawings,
<br />• 'plans, general details and specifications of suc'= improvement approved January 23, 1950,
<br />a.nd to be adopted by the Board of Public Works and Safety of the City of South Bend, im-

<br />The total cost of said improvement, including all incidental costs such as advertis-
<br />ling, abstracting, inspection and engineering, shall be assessed upon the real estate abut

<br />ling to the method and manner"provided for in an Act of the General assembly of the State

<br />land in accordance with and pursuant to the provisions of all amendatory and supplemental
<br />acts thereto, passed by the General .,A.:-ser.Qbly of the State of Indiana.. Assessments, if
<br />• deferred, are to be paid in ten equal installments, with interest at the rate of six (6)
<br />per cent per anr_um. (A bond or bonds shall be -issued to the contractor in payment of
<br />assessments, as the several owners of real estate upon which they are a lien exercise the
<br />fright to pair the same in ten equal installments.) Under no°circumstances shall the City
<br />I�of South Bend, Indiana. be or be held responsible for any sum or sums due from said proper
<br />1 owner or owners for said work, or for the collection of the same, or for the payment of
<br />any certificate or certificates, bond or bonds, issued to said contractor in payment for
<br />such work, except for such moneys as shall have been actually received by the City from
<br />assessments for such improvement, or such moneys as the City is by said entitled .Act and
<br />the provisions of all Acts amendatory and supplemental thereto, required to pay. All
<br />proceedings had and work done in making of said improver.-ent, assessment of property, col-
<br />lection of assessments and issuance of bonds therefor, sha.11 be as provided for in said
<br />entitled Act and amendments thereto.
