<br />Whereas The Board of Public Works, did on the 6th day of July, 1949, adopt a
<br />Preliminary order designating Class "C" Type Four (4) Aompacted Aggregate Base, Bitumi
<br />Concrete Surface as the kind of Pavement for the improvement of THIRTY-SECOND Street,
<br />• from the north line of Pleasant Street to the south line of Vine Street, in accordance
<br />with Improvement Resolution No. 2591, 1949, passed by this Board on April 25, 1949.
<br />Be It Resolved, That the Preliminary Order is hereby, in all things confirmed and
<br />said street ordered paved with a Class "C", Type Four (4) Compacted Aggregate Base, Bit-
<br />uminous Concrete Surface Pavement,

<br />Therefor Be It Resolved, By the Board of Public Works and Safety of the City of Sout
<br />Bend, Indiana, that the bid of the Rieth-Riley Construction Company for the construction
<br />of the improvement described in Improvement Resolution No. 2591, 1949, passed by this
<br />Board on April 25, 1949, be and the same is hereby adopted and that the City of South Ben
<br />Indiana, thru its Mayor and the Board of Public Works and Safety enter into a written
<br />contract with said Rieth-Riley Construction Company for the faithful execution of such
<br />work, according to said bid, the detailed plans and specifications and the terms of said
<br />Resolution, provided that before entering upon the performance of said contract, said
<br />Rieth-Riley Construction Company shall give bond, in the amount equal to one hundred (100
<br />per cent of the contract price for such work, with a Surety Company legally authorized to
<br />transact business in the State of Indiana,'as Surety, to the approval of this Board, to
<br />secure the performance of such contract, and shall give a Maintenance Bond in the amount
<br />equal to fifty (50) per cent of the contract price for such work, with a Surety Company
<br />legally authorized to transact business in the State of Indiana, as Surety, to the approv,
<br />of this Board to warrant and guarantee the stork, material and condition of the pavement
<br />for a period of three (3) years, and to hold the City of South Bend, Indiana, harmless fr
<br />payment of any debt or damage by reason of any act of such Contractor, and to secure the
<br />payment of all claims for labor and material used in such Improvement.
