<br />Whereas, The Board of Public Works, did on the 9th day of June, 1949, adopt a Pre-
<br />• limanary Order designating a Class "C" Type 4-Compacted Aggregate Base, Bituminous Con-
<br />crete Surface as the kind of Pavement for the improvement of Dale Avenue from the South
<br />line of Indiana, Avenue to the N6rth line of Dubail Avenue in accordance with Improve-
<br />ment Resolution No. 2594, 1949, passed by this Board on May 23, 1949.
<br />Be It Resolved, That the Preliminary Order is hereby, is all things confirmed and
<br />'said street ordered paved with a Class "C" Type - Compacted Aggregate Base, Bituminous
<br />Concrete Surface Pavement.

<br />After due investigation of all bids and being duly advised on the premises, the
<br />Board of Public Works and Safety decides that the bid of the Rieth-Riley Construction
<br />(Company for the construction of the improvement known as Dale Avenue Pavement Improve-
<br />ment according to Improvement Resolution No. 2594, 1949, is the lowest and best bid and
<br />that the contract to do said work be awarded to the Rieth-Riley Construction Company.

<br />Therefore Be it Resolved, By the Board of Public Works and Safety of the City of
<br />South Bend, Indiana that the bid of the Rieth-Riley Construction Company for the constr-
<br />uction of the improvement described in Improvement Resolution No. 2594, 1949, passed by
<br />(this Board on May 23, 1949 be and the same is hereby adopted and that the City of South
<br />(Bend, Indiana, thru its Mayor and Board of Public Works and Safety enter into a written
<br />contract with said Rieth-Riley Construction Company for the faithful execution of such !
<br />work, according to said bid, the detailed plans and specifidations and the terms of said
<br />Resolution, provided that before entering upon the performance of said contract, said
<br />Rieth Riley Construction Company shall give bond, in the amount equal to one hundred (100
<br />percent of the contract price for such work, with a Surety Company legally authorized tol
<br />transact business in the State of Indiana, as Surety, to the approval of this Board, to ,
<br />secure the performance of such contract, and shall give a Maintenance Bond in the amount
<br />equal to fifty (50) per cent of the contract price for such work, with a Surety Company
<br />legally authorized to transact business in the State of Indiana, as Surety, to the a.pprov'1
<br />of this Board to warrant and guarantee the work, material and condition of the pavement
<br />for a period of ,three (3) years, and to hold the City of South Bend, Indiana, harmless`
<br />from payment of any debt or damage by reason of any act of such Contractor, and to secure
<br />the payment of all claims for labor and material used in such Improvement.
