<br />Whereas, The Board of Public Works, did on the 9th day of June, 1949, adopt a Pre-
<br />liminary Order designating Class "C"' Typed - Portalnd Cement Concrete as the kind of
<br />Pavement for the improvement of Hamden Court from the North line of LaSalle Avenue to
<br />South line of Alley north of LaSalle Avenue in accordance with Improvement Resolution
<br />No. 2595, 1949. passed by this Board,on May 23, 1949.
<br />Be It Resolved, That the Preliminary Order is hereby, in all things confirmed, and
<br />said street ordered paved with a Class "C" Type - 1, Portland Cement Concrete Pavement,

<br />After due investigation of all bids and being duly advised on the premises the
<br />Board of Public Works and Safety decides that the bid of the Reed Construction Lmpany
<br />for the construction of the improvement known as Hamden Court Pavement Improvement ac-
<br />cording to Improvement Resolution No. 2595, 1949 is the lowest and best bid and that the
<br />contract to do said work be awarded to the Reed Construction Company. Said bid being
<br />as follows:

<br />Therefore Be It Resolved, By the Board of Public Works and Safety of the City of
<br />South Bend, Indiana that the bid of the Reed Construction Company for the construction
<br />of the Improvement described in Improvement Resolution No. 2595, 1949, passed by this
<br />Board on May 23, 19.49, be and the same is hereby adopted and that the City of South Bend,
<br />Indiana, thru its Mayor and Board of Public Works and Safety enter into a written con-
<br />tract with said Reed Construction Company for the faithful execution of such work, accord
<br />ing to said bid, the detailed plans and specifications and the terms of said Resolution,
<br />provided that before entering upon the performance of said contract, said Reed Constructi
<br />Company shall give bond, in the amount equal to one hundred (100) per cent of the contrac
<br />price for such work, with a Surety Company legally authorized to transact business in the
<br />State of Indiana, as Surety, to the approval of this Board, to secure the performance of
<br />such contract, and shall give a Maintenance Bond in the amount equal to fifty (50) per
<br />cent of the contract price for such work, with a Surety Company legally authorized to tra
<br />business in the State of Indiana, as Surety, to the approval of this Board to warrant and
<br />guarantee the work, material and condition of the pavement for a period of three (3) year
<br />and to hold the City of South Bend, Indiana harmless from payment of any debt or damage
<br />by reason of any act of such Contractor, and to secure the payment of all claims for lab-
<br />or and material used in such Improvement.
