<br />Whereas, The Board of Public Works, did on the 9th day of June, 1949, adopt a pre- �
<br />liminary Order designating a Class "C" Type 4 Compacted Aggregate Base, Bituminous Con-
<br />crete Surface as the kind of Pavement for the improvement of Poland Street west line of 11
<br />Olive Street to the East line of Kaley Street in accordance with Improvement Resolutions •
<br />No. 2 592 1949.
<br />Whereas, fifty-one (51) per cent and more of the resident property owners on said III
<br />Poland Street on or before June 21, 191+9 did request in writing that said Poland Street
<br />be paved with a Class "C" Type 1- Portland Cement Concrete pavement.
<br />Be,It Resolved, That the Preliminary Order is hereby rescinded and said street or-
<br />dered paved with Class "C" Type 1-Portland Cement Concrete Pavement.

<br />After due investigation of all bids and being duly advised on the premises, the
<br />Board of Public Works and Safety decides that the bid of the Rieth-Riley Construction !
<br />Company for the construction of the improvement known as Poland Street Pavement improve-1
<br />went according to Improvement Resolution No. 2592, 191+9 is the lowest and best bid and
<br />that the contract to do said work be awarded to the Rieth-Riley Construction Comppny,
<br />Said bid being as follows:

<br />Therefor Be It Resolved, By the Board of Public Works and Safety of the City of ;I
<br />South Bend, Indiana that the bid of the Rieth-Riley Construction Company for the construe
<br />ction of the improvement deveribed in Improvement Resolution No. 2592, 1549, passed by j
<br />this�Board on May-23, 1949 be and the same is hereby adopted and that the City of South
<br />Bend, Indiana, thru its Mayor and Board of Public Works and Safety enter into a written
<br />contract with said R-ieth-Riley Construction Company for the faithful execution of such
<br />works according to said bid, the detailed plans and specifications and the terms of said1l,
<br />Resolution, provided that before entering upon the performance of said contract, said ji
<br />Rieth-Riley Construction Company shall give bond, in the amount equal to one hundred
<br />(100) per cent of the contract price for such work, with a Surety Company legally author;`
<br />ized to transact business in the State of Indiana, as Surety, to the approval of this i1
<br />Board, to secure the performance of such contract, and shall give a Maintenance Bond in
<br />the amount equal to fifty (50) per cent of the contract price for such work, with a
<br />Surety Company legally authorized to transact business in the State of Indiana, as
<br />Surety, to the approval of this Board to warrant and guarantee the work, material and
<br />condition of the pavement for a period of three years (3), and to hold the City of South;!
<br />Bend, Indiana, harmless from payment of any debt or damage by reason of any act of such
<br />Contractor, and to secure the payment of all claims for labor and material used in such jI
<br />Improvement.
