<br />Whereas, The Board of Public Works, did on the 9th day of June, 1949, adopt a Preliminary
<br />• Order designating a Class "C" Type 4-Compacted Aggregate Base, Bituminous Concrete Surfac
<br />as the kind of Pavement for the improvement of Twenty -Fourth Street from the north line o
<br />Mishawaka Avenue to the south property line of Lots "C" and I'D" of Hastings, Woodward &
<br />Grays Addition in accordance with Improvement Resolution No. 2590, 1949, passed by this
<br />Board on May 23, 1949,
<br />Whereas fifty-one (51) per cent and more of the resident property owners on said
<br />Twenty -Fourth Street on or before June 21, 1949 did request in writing that said Twenty
<br />Fourth Street be paved with a Class "C" Type-1 Portland Cement Concrete Pa.tement.
<br />Be It Resolved, That the Preliminary Order is hereby rescinded and said street order d
<br />paved with a Class rrC11 - Type 1- Portland Cement Concrete Pavement.

<br />After due investigation of all bids and being duly advised on the premises the
<br />Board of Public Works and Safety decides that the bid of the Reed Construction Company
<br />for the construction of the improvement known as Twenty -Fourth Street Pavement Improve-
<br />ment according to Improvement Resolution No. 2590, 1949 is the lowest and best bid and
<br />that the contract to do said work be awarded to the Reed Construction Company. Said
<br />bid being as follows:

<br />Therefor Be It Resolved, By the Board of Public Works and Safety of the City of South
<br />Bend, Indiana, that the bid of the Reed Construction Company for
<br />the construction of the
<br />improvement described in Improvement Resolution No. 2590, 1949, passed by this Board on
<br />May 23, 1949 be and the same is hereby adopted and that the City
<br />of South Bend, Indiana,
<br />thru its Mayor and Board of Public Works and Safety enter into a
<br />written contract with
<br />•
<br />said Reed Construction Company for the faithful execution of such work, according to saidJ
<br />bid, the detailed plans and specifications and the terms of said
<br />Resolution, provided tha
<br />before entering upon the performance of said contract, said Reed
<br />Construction Company
<br />shall give bond, in the amount equal to one hundred (100) per cent of the contract price
<br />ifor such work, with a Surety Company legally authorized to transact business in the State
<br />�lof Indiana, as Surety, to the approval of this Board, to secure
<br />the performance of such
<br />contract, and shall give a Maintenance Bond in the amount equal
<br />to fifty (50) per cent ofi
<br />the contract price, for such work, with a Surety Company legally
<br />authorized to transact
<br />business in the State of Indiana, as Surety, to the approval of
<br />this Board to warrant and
<br />guarantee the work, material and condition of the pavement for a
<br />period of three (3) year,,
<br />and to haold the City of South Bend, Indiana, harmless from payment of any debt or damage
<br />by reason of any act of such Contractor, and to secure the payment of all claims for labo
<br />•
<br />and material used in such Improvement.
