<br />Whereas, The Board of Public Works did on the 9th day of June, 1949, adopt a Prel-
<br />iminary Order designating that a Class iC11 Type 4-- Compacted Aggregate Base, Bituminous
<br />Concrete Surface as the kind of Pavement for the improvement of Grace Street from the j
<br />West line of Alley West of Webster Street to the west property line of Oliver Farm Equip-, .
<br />ment Company property in accordance with Improvement Resolution No. 2588, 1949, passed by'
<br />this Board on May 23, 1949. i
<br />Whereas, fifty-one (51) per cent and more of the resident property owners on said ;,
<br />Grace Street on or before June 21, 19499 did request in writing that said Grace Street bell
<br />paved with a Class "CII-Type 1 - Portland Cement Concrete Pavement.

<br />Be It Resolved, That the Preliminary order is hereby rescinded and said street ordered
<br />paved with a Class "C" - Type 1 - Portaland Cement Concrete Pavement.

<br />AWARDING CONTRACT

<br />After due investigation of all bids and being duly advised on the premises, the
<br />Board of Public Works and Safety decided that the bid of the Rieth-Riley Construction Com-
<br />pany for the construction gf the improvement known as Grace Street Pavement Improvement
<br />according to Improvement Rsolution No. 2588, 1949, is the lowest and best bid and that
<br />the contract to do said wor^k be awarded to the Rieth-Riley Construction Company. Said
<br />bid being as follows:

<br />on May 23, 1949, be and the same is hereby adopted and that the City of South Bend, Irrlian4,

<br />and of and Safety enter into a written contract with said

<br />Company for the faithful execution of such work, according to sai'd
<br />bid, the detailed plans and specifications and the terms of said Resolution, provided that!i
<br />(before entering upon the performance of said contract, said Rieth-Riley Construction Com- ;�
<br />any shall give bond, in the amount equal to one hundred (100) per cent of the contract !i
<br />'rice for such work, with a Surety C&mpa.ny legally authorized to transact business in the if
<br />'tate of Indiana, as Surety, to the approval of this Board, to secure the performance of !

<br />such contract, and shall give a Maintenenace Bond in the amount equal to fifty (50) per
<br />Cent of the contract price for such work, with a Surety Company legally authorized to tran L
<br />;act business in the State of Indiana, as Surety, to the approval of this Board to warrent j
<br />ind guarantee the work, material and condition of the pavement for a period of three (3)
<br />ears, and to hold the City of South Bend, Indiana, harmless from payment of any debt or i
<br />by reason of any act Contractor,
<br />,amage of such and to secure the payment of all claims foi
<br />labor and material used in such Improvement. i
