541 <br />IMPROVEMENT RESOLUTION <br />I FINAL ORDER <br />No. 2587, 1949 <br />South Bend, Indiana <br />June 27, 1949 <br />Whereas, The Board of Public Works, did on the 9th day of June, 1949, adopt a Prem- <br />• iliminary Order designating a Class "C" - Type 4-Compacted Aggregate Base, Bituminous <br />Concrete Surface as the kind of Pavement for the improvement of Garden Lane from the <br />north line of Dogwood Drive to 20' north of South line of Sample Street in accordance <br />with Improvement Resolution No. 2587, 1949, passed by this Board on May 23, 1949. <br />Whereas, fifty-one (51) per cent and more of the resident property owners on said <br />Garden Lane on or before June 21, 1949, did request in writing that .said Garden Lane <br />be paved with a Class "C"-Type-1 Portland Cement Concrete pavement. <br />Be It Resolved, That the Preliminary Order is hereby rescinded and said street order <br />paved with a Class rrC�t Type-1 Portland Cement Concrete Pavement. <br />` R. Noble, Clerk <br />IMPROVE10,TT RESOLUTION <br />AWARDING CONTRACT <br />�I No. 2587, 1949 <br />South Bend, Indiana <br />June 27, 1949 <br />After due investigation of all bids and being .duly advised on the premises, the <br />Board of Public Works and Safety decides that the bid of the Reed Construction Company <br />for the construction of the improvement known as Garden Lane pavement Improvement accord- <br />ing to Improvement Resolution No. 2587, 1949, is the lowest and best bid and that the <br />contract to do said work be awarded to the Reed Construction Company. Cement Concrete Combination Curb <br />and Gutter "A" 1.15 2,511.60 <br />5 1580 Sq.Yds Top Soil - 2" Depth .50 790,00 <br />$ 12,781.20 <br />Therefor Be it Resolved, By the Board of Public Works and Safety of the City of Sout i <br />(Bend, Indiana, that the bid of the Reed Construction Company for the construction of the <br />improvement described in Improvement Resolution No. 2587, 1949, passed by this Board on <br />IIMay 23, 1949, be and the same is hereby adopted and that the City of South Bend, Indiana, <br />I�thru its Mayor and Board of Public Works and Safety enter into a written contract with <br />said Reed Construction Company for the faithful execution of such work, according to saidl <br />bid, the detailed plans and specifications and the terms of said Resolution, provided that' <br />before entering upon the performance of said contract, said Reed Construction Comaany <br />shall give bond, in the amount equal to one hundred (100) per cent of the contract price <br />for such work, with a Surety Company legally authorized to transact business in the State <br />Hof Indiana, as Surety, to the approval of this Board, to secure the performance of such <br />• contract, and shall give a Maintenance Bond in the amount equal to fifty (50) per cent of <br />the Contract price for such work, with a Surety Company legally authorized to transact <br />business in the State of Indiana, as Surety, to the approval of this Board to warrent and <br />guarantee the work, material and condition of the pavement for a period of three (3) year!, <br />and to hold the City of South Bend, Indiana, harmless from payment of any debt or damage <br />by reason of any act of such Contractor, and to secure the payment of all claims for labo <br />and material used in such Improvement. <br />R.
