<br />Wheareas, The Board of Public Worksdid on the 9th day of June, 1949, adopt a
<br />Preliminary Order designating a Class 11C11Type 4 Compacted Aggregate Base, Bituminous
<br />Concrete Surface as the kind of Pavement for the improvement of Stanfield Street, from
<br />the south line of Howard Street to the North line of Corby Street, in accordance with
<br />Improvement Resolution No. 2585, 1949, passed by this Board on May 237 1949.
<br />Be It Resolved, That the Preliminary Order is hereby, in all things confirmed and
<br />said street ordered paved with a Class "C" Type 4 Compacted Aggregate Base, Bituminous

<br />After due investigation of all bids and being duly advised on the premises, the
<br />Board of Public Works and Safety decided that the bid of the Rieth-Riley Construction
<br />Company for the construction of the improvement known as the Stanfield Street Pavement
<br />Improvement according to Improvement Resolution No. 2585, 1949 is the lowest and best
<br />bid and that the contract to do said work be awarded to the Rieth-Riley Construction
<br />Company. Said bid being as follows:

<br />Therefor Be It Resolved, By the Board of Public Works and Safety of the City of Sou
<br />Bend, Indiana that the bid of the Rieth-Riley Construction Company for the construction
<br />of the improvement described in Improvement Resolution No. 2585, 1949, passed by this
<br />Board on May 23, 1949, be and the same is hereby adopted and that the City of South Bend
<br />Indian, thru its Mayor and Board of Public Works and Safety enter into a written contrac
<br />with said Rieth-Riley Construction Company -for the faithful execution of such work, ac-
<br />cording to said bid, the detailed plans and specifications and the terms of said Resol-
<br />ution, provided that before entering upon the performance of said contract, said Rieth
<br />Riley Construction Company shall give bond, in the amount equal to one hundred (100) per
<br />cent of the contract price for such work, with a Surety Company legally authorized to
<br />transact business in the State of Indiana, as Surety, to the approval of this Board, to
<br />secure the performance of such contract, and shall give a Maintenance Bond in the amount
<br />equal to fifty (50) per cent of the contract price for such work, with a Surety Company
<br />legally authorized to transact business in the State of°Indiana, as Surety, to the appro,
<br />of this Board to warrent and guarantee the work, material and condition of the pavement
<br />fora period of three (3) years, and to hold the City of South Bend, Indiana, harmless
<br />from payment of any debt or damage by reason of any act of such Contractor, and to se-
<br />cure the payment of all claims for labor and material used in such Improvement.
