540 Pursuant to the recommendation of the City Plan Commission the vacation of the alley between St. Joseph and Carroll Streets south from Dubail .venue is hereby denied. The Clerk of the Board was directed to so inform the petitioners. IMPROVEMENT RESOLUTION No. 25857 1949 South Bend, Indiana FINAL ORDER June 27, 1949 Wheareas, The Board of Public Worksdid on the 9th day of June, 1949, adopt a Preliminary Order designating a Class 11C11Type 4 Compacted Aggregate Base, Bituminous Concrete Surface as the kind of Pavement for the improvement of Stanfield Street, from the south line of Howard Street to the North line of Corby Street, in accordance with Improvement Resolution No. 2585, 1949, passed by this Board on May 237 1949. Be It Resolved, That the Preliminary Order is hereby, in all things confirmed and said street ordered paved with a Class "C" Type 4 Compacted Aggregate Base, Bituminous Concrete Surface Pavement, R. Noble BOARD OF PUBLIC WORKS & Clerk of the Board SAFETY IMPROVEMENT RESOLUTION AWARDING CONTRACT No. 2585, 1949 South Bend, Indiana June 27, 1949 After due investigation of all bids and being duly advised on the premises, the Board of Public Works and Safety decided that the bid of the Rieth-Riley Construction Company for the construction of the improvement known as the Stanfield Street Pavement Improvement according to Improvement Resolution No. 2585, 1949 is the lowest and best bid and that the contract to do said work be awarded to the Rieth-Riley Construction Company. Cement Concrete Curb - 3.00 60.00 5 1 Each Resetting Sewer Manhole Ring & Cover 15.00 15.00 6 2 Each Resetting Stortniater Inlet Ring & Grate 15.00 30.00 $ 49603- o Therefor Be It Resolved, By the Board of Public Works and Safety of the City of Sou Bend, Indiana that the bid of the Rieth-Riley Construction Company for the construction of the improvement described in Improvement Resolution No. 2585, 1949, passed by this Board on May 23, 1949, be and the same is hereby adopted and that the City of South Bend Indian, thru its Mayor and Board of Public Works and Safety enter into a written contrac with said Rieth-Riley Construction Company -for the faithful execution of such work, ac- cording to said bid, the detailed plans and specifications and the terms of said Resol- ution, provided that before entering upon the performance of said contract, said Rieth Riley Construction Company shall give bond, in the amount equal to one hundred (100) per cent of the contract price for such work, with a Surety Company legally authorized to transact business in the State of Indiana, as Surety, to the approval of this Board, to secure the performance of such contract, and shall give a Maintenance Bond in the amount equal to fifty (50) per cent of the contract price for such work, with a Surety Company legally authorized to transact business in the State of°Indiana, as Surety, to the appro, of this Board to warrent and guarantee the work, material and condition of the pavement fora period of three (3) years, and to hold the City of South Bend, Indiana, harmless from payment of any debt or damage by reason of any act of such Contractor, and to se- cure the payment of all claims for labor and material used in such Improvement.
