440 FINAL ORDER IMPROVEMENT RESOLUTION NO. 2571 1948 October 117 1948 Whereas, the Board of Public Works, did on the 28th day of September 1948, 11 � adopt a. Preliminary Order designating Class C. Type 4, Compacted Aggregate Base, Bitumino�'s concrete surface as the kind of Pavement for the improvement of Liberty Street, from Sout4 line of Western Avenue to North line of Sample Street in accordance with Improvement Resolution No. 2571 1948,.passed by this Board on September 3, 1948. • Be It Resolved, That the Preliminary Order is hereby, in all things confirmed and said street ordered paved with a Class C. Pajakowski, Clerk j li AWARDING CONTRACT After due investigation of all bids and being duly advised in the premises, the Board of Public Works and Safety decides that the bid of the Rieth-Riley Construction Company for the construction of the improvement known as Liberty Street Pavement i mprove- ment according to Improvement Resolution No. 2571 1948, is the lowest and best bid and that the contract to do said work be awarded to the Rieth-Riley Construction Company. (50) per cent of the contract price for such work, with a Surety Company leg- 1' alley authorized to transact business in the State of Indiana, as, Surety, to the appruva of the,Boa.rd to warrant and guarantee the work, material and condition of the pavement fop a, period of three (3) years, and to hold the city of South Bend, Indiana, harmless from payment of any debt or damage by reason of any act of such Contractor, and to secure the j payment of all claims for labor and material used in subh improvement.
