<br />VACATION RESOLUTION NO. 2578
<br />This being the date set, hearing was had on the a.ssessment roll showing the award
<br />benefits in the matter of the vacation of the alley incest
<br />of damages and the assessment of
<br />of Ironwood Drive from Ewing Avenue to the Alley South under vacation resolution No. 2578
<br />In the above named assessment roll, no,remonstrators appeared and no written remon-
<br />strances were filed, The Clerk of the Board submitted proofs of publication and same
<br />the Board, therefore, finds that the several lots and parcels
<br />•
<br />were found sufficient, and
<br />of land have been benefitted and,damaged in the amounts shown on said roll. The Board,
<br />therefore, decides to take final action on said assessment roll and declares same in all
<br />things ratified, confirmed and approved without modification and the proceedings closed,
<br />and the alley vacated upon receipt of the amount of benefit assessments from the various
<br />property owners so benefitted and all proceedings had with reference to said alley vaca-
<br />tion are hereby sustained.

<br />in accordance with Improvement Resolution No. 2567 19481_ passed by this Board on Septembe
<br />13, 1948.
<br />Be It Resolved, that the Preliminary Order is hereby, in all things confirmed and
<br />aid°street ordered paved with a Class C, Type 4, Compacted Aggregate Base, Bituminous
<br />ksoncrete
<br />Surface Pavement.

<br />-. After due investigation of all bids and being duly advised in the premises, the
<br />• ,Bo4. d of Public Works and Safety decides that the bid of the Rieth-Riley Construction
<br />(Company for the construction of the improvement knoVm as O'Brien Street Pavement Improve-
<br />�ment according to Improvement Resolution No. 2567 1948, is the lowest and best bid and
<br />that the contract to do said work br awarded to the Rieth-Riley Construction Company.

<br />Therefor be it Resolved, By the Board of Public Works and Safety of the City of
<br />South Bend, Indiana that the bid of the Rieth-Riley Construction Company for the con-
<br />Iistruction of the improvement described in Improvement Resol-ttion No, 2567 1948, passed
<br />Eby this Board on September 3, 1948 be and the same is hereby adopted and that the City
<br />• I of South Bend, Indiana, thru itsMayor Mayor and Board of Public Works and Safety enter into a
<br />written contract with said Rieth-Riley Construction Company for the faithful execution of
<br />such work, according to said bid, the detailed plans and specifications and the terms of
<br />said Resolution, provided,tha.t before entering into the performance of said contract,
<br />said Rieth-Riley Construction Company shall give bond, in the amount equal to one
<br />1hundred (100%) per cent of the contract price for such work, with a Surety Company
<br />legalley authorized to transact business in the State of Indiana, as Surety, to the
<br />approval of this Board, to secure the performance of such contract, and shall give a
<br />Maintenance bond in the amount equal to fifth (50) percent of the contract price for such
<br />work, with a. Surety Company legally authorized to transact business in the State of India:
<br />as Surety7 to the approval of this Board to warrant and guarantee the work, material and
<br />condition of the pavement for a period of three (3) years, and to hold the City of South
<br />• Bend, Indiana, harmless from payment of any debt or damage by reason of any act of such
<br />Contractor, and to secure the payment of all claims for labor and material used in such
