<br />The same to be done in accordance with the profiles, drawings plans, general details
<br />and specifications of such improvement approved August 9, 191rA and to be adopted by the
<br />Board of Public �dorks and Sa:fety of the City of South Bend, irimediately upon the final
<br />adopted of this resolution, and placed on file in the office of the City Civil Engineer
<br />of said City, and such improvement is now ordered.
<br />The total cost of said improvement including all incidental costs such as advertisii
<br />abstracing, inspection and engineering,�shall be assessed upon the real estate abutting
<br />on said O'Brien Street to be unproved, all according to the method and ria��ner provided
<br />• for in an Act of the General Asser.bly of the State of Indiana, entitled, an Act Concern-
<br />ing I"unicipal Corporations" approved March 6th, 1�'05, and in accordance with and pursuant
<br />to the provisions of all amendatory and supplemental z cts thereto, passed by she General
<br />Assembly of the State of Indiana. Assessments, if deferred, are to be paid in ten equal
<br />installr.ents with interest at the rate of five (5) per cen�, per am-lum. (A bond or bonds
<br />shall be issued to the contractor in parsnent of assessments, �s the several oZ- of
<br />.real estate upon which they are a lien exercise the right to pay the same in ten equal
<br />installments.) Under no circumstances shall the City of South Ber_d, Indiana, be or be
<br />(held responsible for any sum or sums due from said property owner or owners for said work
<br />Ior for certificate o- certificates, bond or bonds, issued to said contractor in payment
<br />except for such moneys as shall have been actually received by the City from assessment
<br />for such improvement, or such moneys as the Cjit is by said entitled Act and the provi-

<br />the time, and the office of the Board in said City as the place, when and where all persc
<br />whose property may be affected by such proposed improvement, may be heard as to the nec-
<br />lessit for the same and all petitions and remonstrances received and the Board will on
<br />said day decide whether the benefits accruing to abutting and adjacent property, and to
