<br />The same to be done in accordance with the profiles, drawings, plans, general details a
<br />specifications of such irr_provement approved August 9, 1948 and to be adopted by the Boa
<br />of Public Works and Safety of the City of South Bend, irmediately upon the final adopti
<br />of this resolution, and placed on file in the office of the City Civil Engineer of said
<br />City, and such improvement is now ordered.
<br />The total cost of said improvement, including all incidental costs such as advertis
<br />ing, abstracting, inspection and engineering, shall be assessed upon the real estate
<br />.butting on said South Liberty Street to be improved, all according to the method and ma.
<br />ner provided for in an Act of the General Assembly of the State of Indiana, entitled, "A
<br />Act Concerning Mu.zicipal Corporations" approved I,11arch o, 1905, a.nd in accordance with an
<br />pursuant to the provisions of all amendatory and supplemental acts thereto, passed by th
<br />General Assembly of the State of Indiana. Assessments, if deferred, are to be paid in
<br />ten equal installments with interest at the rate of five (5) percent per annum. (A bond
<br />or bonds shall be issued to the contractor in pay`rlent of assessments, as the several
<br />owners of real estate upon which they are a lien exercise the right to pay the sane in
<br />ten equal installments.) Under no circumstances shall the City of South Bend, Indiana,
<br />be or be held responsible for any surz or sums due from said property owner or owners for
<br />said work, or for certificate or certificats bond or bonds, issued to said contractor in
<br />payment for such work, except for such moneys as s__all have been actually received by
<br />the City from asses:_,..: ent for such ir:_proverrent, or such moneys as the City is by said en-
<br />titled Act and the provisions of all Acts amendatory and supplemental thereto, required
<br />to pay. All proceedings had and work done in raking of said improvement, a.ssessriient of
<br />property, collection of assessments and issuance of bonds therefore, small be as provide
<br />for in said entitled Act and amendments thereto.
<br />Friday, September 3, 19L8 at the hour of 7:30 r'._=. O'clock (CDT) is hereby' fixed
<br />as the time, and the office of the Board in said City as the place, when and where all
<br />persons -uhose property may be affected by such proposed improvement, may be heard as to
<br />the necessity for the same, and all petitions and rer:.onstrances received and the Board
<br />will, on said day, decide T-,Tether the ber_efits accruing to abutting and adjacent prope_°t
<br />and to the City of South :send, Indi ana, .rill be equal to or exceed the estimated cost of
