REGULAR MEETING <br />JULY 25, 2017 227 <br />WHEREAS, as a result of the vast array of activity involving the City's Public Works <br />Department, staff of the City's Public Works Department receive frequent requests to perform <br />administrative functions on behalf of the department, including but not limited to, executing the <br />transfer of title to personal property, the submission of forms to other various entities, the <br />certification of the senior citizen rate for refuse, and the execution of documents related to the <br />ownership and maintenance of property; and <br />WHEREAS, the Board desires to expressly authorize the department's Director to take <br />such administrative acts and to execute such administrative documents as necessary to provide <br />for the proper maintenance and management of its property interests. <br />NOW, THEREFORE, BE IT RESOLVED by the South Bend Board of Public Works as <br />follows: <br />1. Mr. Eric Horvath, in his capacity as Director of the City of South Bend's <br />Department of Public Works is authorized to perform, on behalf of the Board, <br />administrative acts related to the department's transfer of title to personal <br />property, the submission of forms to other various entities, the certification of the <br />senior citizen rate for refuse, and the execution of documents related to the <br />ownership and maintenance, of property. For purposes of this Resolution, an <br />administrative act is one in which the Director determines, upon the advice of <br />legal counsel, that said act occurs within the normal course of owning, operating, <br />or managing department property and does not adversely impact an interest of the <br />Board. <br />2. This Resolution shall be in full force and effect after its adoption. <br />ADOPTED at a meeting of the Board of Public Works of the City of South Bend, <br />Indiana held on July 25, 2017, at 1308 County -City Building, 227 West Jefferson Boulevard, <br />South Bend, Indiana 46601. <br />CITY OF SOUTH BEND <br />BOARD OF PUBLIC WORKS <br />s/ Gary A. Martin, Clerk <br />ADOPT RESOLUTION NO. 28-2017 — A RESOLUTION OF THE SOUTH BEND BOARD <br />OF PUBLIC WORKS ON DISPOSAL OF UNFIT AND/OR OBSOLETE PROPERTY <br />Upon a motion made by Ms. Maradik, seconded by Ms. Dorau and carried, the following <br />Resolution was adopted by the Board of Public Works: <br />RESOLUTION NO. 28-2017 <br />A RESOLUTION OF THE SOUTH BEND BOARD OF <br />PUBLIC WORKS ON DISPOSAL OF UNFIT <br />AND/OR OBSOLETE PROPERTY <br />WHEREAS, it has been determined by the Board of Public Works that the following <br />property is unfit for the purpose for which it was intended and is no longer needed by the City of <br />South Bend: <br />2003 Pierce Enforcer Fire Truck <br />WHEREAS, Indiana Code 5-22-21-6(4)(B) permits and establishes procedure for <br />disposal of personal property which is considered worthless, has no market value, or if the value <br />of the property is less than the estimated costs of the sale and transportation of the property. This <br />equipment is no longer needed by the City. <br />
