4. ESG will make reasonable and proper efforts to provide protection for all persons or <br />property at the event together with the Morris/Palais/CC' premises and personnel, as <br />designated by the Morris/Palais/CC prior to the commencement of each event, against <br />theft, pilferage, malicious injury, and other property damage and destruction. ESG will <br />exert reasonable efforts to protect all persons who enter onto the Morris/Palais/CC from <br />death and personal injury from any cause whatsoever, including the commission by any <br />person of any felony or misdemeanor; provide aid and assistance to all law enforcement <br />agencies as requested, in the enforcement of applicable laws and regulations, including <br />those governing the Indiana Alcoholic Beverage Commission and any on premise <br />licenses issued by it; enforce Morris/Palais' rules and regulations for events, provided <br />such rules and regulations have been previously communicated to ESG in writing. <br />5. ESG will make reasonable and proper efforts to prevent unauthorized entry to events or <br />restricted areas during events. If circumstances require ESG to detain any person, such <br />action will be in accordance with all applicable local, state and federal law. Any detention <br />will be only for the amount of time required until the detained person can be turned over <br />to the appropriate law enforcement officials. <br />Key Personnel Requirements <br />The ESG must identify and designate no less than three (3) individuals as key personnel. Should <br />any of the named individual be unavailable to perform on behalf of ESG under this Agreement, <br />whether due to termination of employment or otherwise, then ESG shall provide a suitable <br />replacement acceptable to the Morris/Palais/CC. Acceptability is to be determined by the <br />Monis/Palais/CC at its option, sole and unfettered discretion. Failure to provide key personnel, <br />or a replacement satisfactory to the Morris/Palais/CC, shall be deemed a ma*rial breach entitling <br />the Morris/Palais/CC, at its option and sole discretion, to immediately termiriate this Agreement. <br />Security Officer Qualifications <br />ESG guarantees that all Security Officers provided to the Morris/Palais/CC meet all State of <br />Indiana requirements for said type employment. In addition, all ESG supplied Security Officers <br />to the Morris/Palais/CC must meet the following requirements: <br />I . Must be 21 years of age or older. <br />2. Must have no felony convictions, <br />3. Must meet appropriate background checks e.g., drug testing. <br />4. Must have a minimum of one (1) full year experience as a security officer, police officer <br />or on a military police force for placement at the Morris/Palais/CC as a security guard. <br />5. Must have a minimum of two (2) full years experience as a security officer, police officer <br />or on a military police force plus job specific training for placement at the <br />Morris/Palais/CC as a supervisor. <br />G. Communication in a language other than English is a plus; however, the population in the <br />greater region is such that to communicate effectively, the English language is primary <br />for both oral and written communication. <br />7. Must be able to exercise judgment and make decisions as to appropriate action under <br />pressure in accordance with rules, regulations, policies and the laws of the State of <br />Indiana. <br />W <br />
