AGREEMENT <br /> THIS AGREEMENT, made and entered into as of this <br /> day of , 1971, by and between the CITY OF <br /> SOUTH BEND, INDIANA, through its Board of Public Works and <br /> Safety (hereinafter referred to as "City") , and INDIANA BELL <br /> TELEPHONE COMPANY, INCORPORATED , an Indiana corporation (herein- <br /> after referred to as "Company") , <br /> WITNESSETH THAT: for and in consideration of the <br /> mutual covenants herein contained, the parties hereto agree <br /> as follows: <br /> 1. Company agrees to furnish, install and maintain <br /> for use by City a complete Special Emergency Reporting PBX <br /> System, particularly described in Attachment "A", made a part <br /> hereof (hereinafter referred to as "System") , subject to the <br /> rates and charges particularly set forth in said Attachment "A", <br /> and the terms and conditions provided in its tariffs filed with <br /> and approved by the Public Service Commission of Indiana, all of <br /> which are subject to modification by the Company from time to <br /> time. In the event Company seeks to increase any of the rates <br /> and charges provided under Attachment "A", in addition to any <br /> legal notice required, Company shall give City written notice <br /> by U. S. Certified Mail, not less than thirty (30) days prior to <br /> the proposed effective date of any such increase. <br /> 2. Company agrees that the System, including asso- <br /> ciated equipment and reporting dispatch lines furnished hereunder, <br />
