REGULAR MEETING FEBRUARY 14 2017 38 <br />Engineering stated their records show a discrepancy in property ownership with two (2) different <br />property owners listed. Engineering and the Fire Department state the vacation would make <br />access to the lands of the aggrieved person by means of public way difficult or inconvenient due <br />to one (I) property with garage access on the alley. Ms. Maradik stated the garage is located on <br />the north alley, and this vacation request is for the south section, so the garage access is not an <br />issue. She noted also that the property ownership for both properties has since transferred to the <br />petitioner so that is also not an issue. Mc Gilot noted this vacation will create a `T' with the <br />east/west alley and should therefore be approved subject to the installation of a taper by the <br />_.. applicant. Therefore, Ms. Maradik made a motion recommending approval of the request for <br />vacation subject to installation of a taper for turning access. Mr. Mueller seconded the motion <br />which carried. <br />FAVORABLE RECOMMENDATION - PETITION TO VACATE THE STREETS AND <br />ALLEYS SOUTH, EAST. AND WEST OF EDDY STREET AT EDDY COMMONS <br />Mr. Gilot indicated that Mr. Tony Halsey, Kite Realty Group, 30 Meridian Street, Indianapolis, <br />Indiana 46204 has submitted a request to vacate the following alleys and streets: <br />a) North/South Alley making up former Eddy Street, South of Howard Street <br />and North of Corby Blvd. including all Right -of -Way to South Bend <br />Avenue and former South Bend Avenue <br />b) North/South Alley South of St. Vincent Street, East of Eddy Street <br />including Two (2) East/West Alleys North of Howard Street, South of St. <br />Vincent Street and Non -Vacated Right -of -Way West of SR 23 at South <br />End of former Georgiana Street <br />c) Eastern 170+ Feet of the East/West Alley West of Eddy Street between St. <br />Vincent Street and Howard Street <br />d) Northwest Comer of Howard Street and Eddy Street including Excess <br />Right -of -Way from Former Howard Street Alignment <br />Mr. Halsey indicated the purpose for the requests is for retail development for a) and d), and <br />residential and mixed -use development for b) and c). Mr. Gilot advised the Board is in receipt of <br />favorable recommendations concerning these vacation petitions from the Solid Waste <br />Department, Community Investment, Engineering, Police Department, Fire Department, and <br />Area Plan Commission. Area Plan stated the vacations would not hinder the growth or orderly <br />development of the unit or neighborhood in which they are located or to which they are <br />contiguous. The vacations would not make access to the lands of the aggrieved person by means <br />of public way difficult or inconvenient. The vacations would not hinder the public's access to a <br />church, school or other public building or place. The vacations would not hinder the use of a <br />public right-of-way by the neighborhood in which they are located or to which they are <br />contiguous. Engineering stated the vacations are recommended subject to all existing utility <br />easements. Therefore, Ms. Maradik made a motion recommending approval of the request for <br />vacation. Mr. Mueller seconded the motion which carried. <br />APPROVE TRAFFIC CONTROL DEVICES <br />Upon a motion made by Ms. Maradik, seconded by Mr. Mueller and carried, the following traffic <br />control devices were approved: <br />NEW INSTALLATION: No Parking Here to Comer <br />LOCATION: 1409 Miami Street <br />REMARKS: All criteria has been met <br />NEW INSTALLATION: <br />Handicapped Parking Sign <br />LOCATION: <br />201 S William Street in front of Quality Care Pharmacy <br />REMARKS: <br />All criteria has been met <br />NEW INSTALLATION: <br />Speed Limit Sign — 25 mph <br />LOCA IONS: <br />Scott Street from Ewing Avenue to Indiana Avenue; and <br />Lafayette Falls Subdivision <br />REMARKS: <br />All criteria has been met <br />REMOVE: <br />30 mph Speed Limit Sign <br />INSTALL: <br />25 mph Speed Limit Sign <br />LOCATION: <br />Liberty Street from Sample to Western <br />REMARKS: <br />All criteria has been met <br />
