However, <br />they have failed to do so. <br />After hearing Mr. Weldy$ it was the decision of the Board to continue <br />this case until October 28, 1963. <br />A progress report on property owned by Melvin and Jessie Moore, located <br />at 1013 S. Fellows Street wh,bh house had been damaged by fire, was <br />given by Mr. Moore._ Mr. Moore advised that he had the insurance money <br />from the claim and has a man who will make the necessary repairs. <br />Case continued until October 281, 1963. <br />With reference to property owned by Mr. Goldberg, located at 320 S. <br />William Street, the Board was advised by Mr. Grabarz that a notice to <br />appear before the Board on this date had been sent to Mr. Goldberg <br />but that he had failed to appear. <br />The Board directed Mr. Grabarz to send another notice which would <br />be the final notice. <br />BUILDING DEPARTMENT: RULING ON SET -BACK LINE SOUTH BEND NORTH UNIT <br />JEHOVAH'S WITNESSES PROPERTY ) <br />The Board directed Louis Smogor, Building Commissioner, to issue a <br />building permit to the Board of Trustees of South Bend, Indiana North <br />Unit of Jehovah's Witnesses to locate and build a church building on <br />the following described property: <br />Lot numbered Twenty-two (22) and the south 2 of Lot Number <br />Twenty-three (23), all as shown on the recorded Plat of <br />Hartman and Miller's Plat, an Addition to the City of South <br />Bend, recorded December 10, 1898 in Plat Book 7, page 29. <br />Such building permit shall recognize the set -back line asset forth <br />by the Zoning Ordinance only. The Board ha`s decided not to recognize <br />the set -back line as set out by the Board of Public Works & Safety and <br />adopted on April 16, 1934 because such set -back line was never recorded <br />in the County Recorder's Office. Therefore, the purchasers of this <br />land, their attorneys and the contracting company had no way of knowing <br />that such set -back line existed. <br />This, in the Board's estimation, worked a hardship on the purchaser of <br />this land, otherwise known as South Bend Indiana North Unit of <br />Jehovah's Witnesses. <br />ELECTRICAL DEPARTMENT STREET LIGHTS - PETITIONS <br />Petitions for street light installations at the following locations <br />were referred to the Electrical Department for investigation and <br />recommendation: <br />1.
