<br />HEARING ON ASSESSMENT ROLL - IMPROVEMENT NO. 3282 - WALL STREET
<br />This being the date set, hearing was held on the assessment roll for the im-
<br />provement of Wall Street, from Ironwood Street to 24th Street, by constructing
<br />a Class C pavement, Type IV. The Clerk tendered proofs of publication of notice
<br />in the South Bend Tribune and the Tri County News on Decembe.r 12 and December
<br />19, 1969, which were read and found to be sufficient.
<br />Dallas Lung, 801 23rd Street, South Bend, Indiana, appeared before the Board
<br />in responsecto notice of the hearing. His only question was how the assess-
<br />ment was to be paid, which was explained. No remonstrators having appeared
<br />and no written remonstrances having been received, upon motion made, seconded
<br />and carried, the assessment roll adopted December 8, 1969, was in all things
<br />confirmed.
<br />AREA PLAN RECOMMENDATION AND ADOPTION OF VACATION RESOLUTION NO. 3307, 1969 -
<br />MOSSBERG AND,. -,COMPANY
<br />Area Plan Commission recommends to the Board the vacation of the north -south
<br />alley between Tutt and Sample Streets and the east -west alley between Carroll
<br />and Fellows Streets.
<br />And the Board, upon motion made, seconded and carried, adopts Resolution No.
<br />3307, 1969, as follows:
<br />"RESOLVED BY THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY
<br />OF SOUTH BEND, INDIANA, that it is desirable to vacate the following:
<br />Beginning at the southeast corner of Lot 6 in William S.
<br />Anderson's Subdivision in -the City of South Bend, Indiana;
<br />thence north along the east line of said Lot 6 to the north-
<br />east corner thereof; thence east along the north line of
<br />Lots 5, 4, 3 and 2 in said Subdivision, to the southwesterly
<br />line of Tutt Street; thence northwesterly along the south-
<br />westerly line of Tutt Street to the southeast corner of Lot
<br />12 in said Subdivision; thence west along the south line of
<br />Lots 12, 11 and 10 to a point on the west line of said Lot 6
<br />as extended northerly; thence south to the northwest corner of
<br />said Lot 6; thence east on the north line of said Lot 6 to
<br />a point 14 feet west of the northeast corner of said Lot 6; thence
<br />south'on a line parallel with and 14 feet west of the east
<br />line of said Lot 6, to the south line of said Lot 6; thence
<br />east 14 feet to the place of beginning, in St. Joseph County,
<br />Indiana.
<br />Reserving the rights and easements of all Utilities and the Municipal
<br />City of South Bend, Indiana, to construct and maintain any facilities,
<br />including, but not limited to, the following: electric, telephone,
<br />gas, water, sewer, surface water control structures and ditches, within
<br />the vacated right of way, unless such rights are released by the
<br />individual Utilities.
<br />The following property may be injuriously or beneficially affected
<br />by such vacation:
<br />Lots 2, 3, 4, 5, 6, 10, 11 and 12 in William S. Anderson's
<br />Subdivision.
<br />Notice of this Resolution shall be published on the 2nd day of
<br />January, 1970 and the 9th day of January, 1970, in the South Bend
<br />Tribune and in the Tri County News.
<br />This Board at its office, on the 12th day of January, 1970, at
<br />9:36 6'clock, A.M., will hear and receive remonstrances from all persons
<br />interested in or affected by these proceedings.
<br />Adopted this 29th day of December, 1969.
