<br />ELETION OF MINUTE AT PAGE 271
<br />It was moved by Mr. Crumpacker, seconded and unanimously carried, that
<br />that portion of the minutes for September 22, 1969, referring to Vacation
<br />Resolution No. 3302 (at page 271) be totally deleted.
<br />FA LING OF ASSESSMENT ROLL - VACATION RESOLUTION NO. 33o4 - O'BRIEN CORP.
<br />Lloyd S. Taylor, City Engineer, files assessment roll, showing award of
<br />damages and assessment of benefits, in Vacation Resolution No. 3304,
<br />being for the vacation of Brookfield Street, from Washington Street to
<br />Orange Street; and Colfax Street, from Brookfield Street east, to the
<br />first north -south alley east of Brookfield Street.
<br />Reserving the rights and easements of all utilities and the municipal
<br />City of South Bend, Indiana, to construct and maintain any facilities, in-
<br />cluding, but not limited to, electric, telephone, gas, water, sewer, surface
<br />water control structures and ditches within the vacated right of way unless
<br />such rights are released by the individual utilities.
<br />Total net damages $00.00
<br />Total net benefits $00.00
<br />The following property may be injuriously or beneficially affected by such
<br />vacation:
<br />Lots 28, 29, 32, 33, 44 and 45 of College Grove Addition.
<br />Upon motion made, seconded and carried, the Board adopted said assessment
<br />roll and set 9:30 A.M. on November 3, 1969, as the date for hearing all
<br />persons interested in or affected by said vacation. And the Clerk was
<br />directed to publish notice of such hearing in the South Bend Tribune and the
<br />Tri County News on October .10,October 17, October 24, 1969.
<br />ADOPTION OF VACATION RESOLUTION NO-. 3305 1969 - SEARS ROEBUCK & COMPANY
<br />Preliminary adoption of the following vacation resolution No. 3305 w6s moved,
<br />seconded and unanimously carried:
<br />"RESOLVED BY THE BOARD OF PUBLIC WORKS AND SAFETY OF THE
<br />CITY OF SOUTH BEND, INDIANA, That it is desirable to vacate
<br />the following:
<br />The north -south alley between Lafayette Boulevard and
<br />Franklin Street, from Monroe Street north to the north
<br />right of way line of the first east -west alley.
<br />The east -west alley between Monroe Street and Western
<br />Avenue from Franklin Street east, to the west right of
<br />way`line of the north -south alley between Franklin
<br />Street and Lafayette Boulevard.
<br />The east -west alley between Monroe Street and Western
<br />Avenue, from Franklin Street west to the east right of
<br />way line of the north -south alley between Franklin Street
<br />and William Street.
<br />Reserving the rights and easements of all Utilities and the
<br />Municipal City of South Bend, Indiana, to construct and maintain
<br />any facilities, including, but not limited to, the following:
<br />electric, telephone, gas, water, sewer, surface water control structures
<br />and ditches, within the vacated right of way, unless such
<br />rights are released by the individual utilities.
<br />The following property may be injuriously or beneficially
<br />affected by such vacation:
<br />of Block 8, and
<br />Lots 4, 51 27 „ 28, 29, 30 and 31 of Vail's Southwest Addition,
<br />and Lots 64, 65 and 66 of Martin's Addition.
