Taylor, City Engineer, files assessment roll showing award of damages and assessment of benefits in Vacation Resolution No. 3303, being for the vacation of: 0 Alley between Rockne Drive and MacArthur Avenue CIS from Chimes Boulevard to Pyle Avenue Reserving the rights and easements of all utilities and the Municipal City of South Bend, Indiana, to construct and maintain any facilities, including but not limited to electric, telephone, gas, water, sewer, surface water control structures and ditches within the vacated right- of-way unless such rights are released by the individual utilities. VACATION RESOL MON NO 3304 - O'BRIEN CORPORATION This being the date set for reopening this matter after having been continued from September 15, 1969, and upon motion made, seconded and unanimously carried, Vacation Resolution No. 3304 is finally approved as originally adopted, and the matter is referred back to the City Engineer for the preparation of an Assessment Ro11, CUAPLAINT RE: W. CALVERT - IMPROVEMENT RESOLUTION N0, 3267,E 1968 Mrs. Eldon Shipley of 1710 W. Calvert and Mrs. Howard McCombs of 1706 W. Calvert appeared to protest the replacement of sod between the curb and the sidewalk at one house in the block and not at theirs. Mr. Worley of Clyde Williams Assoc. was present and explained the sod which was replaced was of sufficient quality that it could be rolled and then laid back down after con- struction while the sod on the parkways of the other properties was not. This matter is referred to the City Engineer for investigation.
