<br />IMPROVEMENT RESOLUTION NO. 3265, 1968 (AMENDED) - CLYDE STRIEET
<br />Upon motion made, seconded and unanimously carried, Improvement Resolution
<br />No. 3265, 1968, being for the improvement of Clyde Street, from Donald
<br />Street to Calvert Street, by constructing a Class C pavement, was amended
<br />to read as follows;
<br />"BE IT RESOLVED, by the Board of Public Works
<br />and Safety of the City of South Bend, Indiana, that it is deemed
<br />necessary to improve Clyde Street, from Donald to Calvert, by con-
<br />structing a Class C pavement with curb repair.
<br />The same to be done in accordance with the pro-
<br />files, drawings, plans, general details and specifications for such
<br />improvement approved September 23, 1968, and to be adopted by the
<br />Board of Public Works and Safety of the City of South Bend, Indiana,
<br />immediately upon the final adoption and confirmation of this
<br />resolution, and placed on file in the office of the Board of Public
<br />Works and Safety of said City, and such improvement is now ordered.
<br />The total cost of said improvement, including
<br />all incidental costs such as advertising, abstracting, inspection
<br />and engineering, shall be assessed upon the real estate abutting
<br />on said Clyde Street to be improved, all according to the method
<br />and manner provided for in an Act of the General Assembly of the
<br />State of Indiana, entitled "An Act Concerning Municipal Corporations"
<br />approved March 6, 1905, and an Act of the general Assembly of the
<br />State of Indiana entitled "An Actii:Concerning Municipal Corporations"
<br />approved February 27, 1953, and in accordance with and pursuant to
<br />the provisions of all Amendatory abd Supplemental Acts thereto,
<br />passed by the General Assembly of the State of Indiana. Assessments,
<br />if deferred, are to be paid in five (5) equal installments, with
<br />interest at the rate of six percent (60%) per annum. Assessments,
<br />either cash or deferred, and such costs as said City is by said
<br />entitled Acts and provisions of all Acts amendatory and supplemental
<br />thereto, required to pay, shall be paid into the General Improve-
<br />ment Fund of the City of South Bend, Indiana. All costs in making
<br />of said improvement shall be paid from said General Improvement Fund.
<br />All proceedings had and work done in making of said improvement,
<br />assessment of property, collection of assessments and issuance of
<br />bonds therefor, shall be as provided for in said entitled Act and
<br />amendments thereto.
<br />The 28th day of May, 1969, at the hour of 7:30
<br />o'clock, P.M., local time, is hereby fixed as the time and the
<br />office of the Board, in said city as the place, when and where
<br />all persons whose property may be affected by such proposed improve-
<br />ment may be heard as to the necessity for the same, and all petitions
<br />and remonstrances received and the Board will, on said day, decide
<br />whether the benefits accruing to abutting and adjacent property
<br />and to the City of South Bend, Indiana. will be equal to or exceed
<br />the estimated cost of said improvement. The Clerk of the Board is
<br />hereby ordered to give notice by two weekly publications of the
<br />time and place of hearing of this resolution.
