<br />estimated cost of said improvement. The Clerk of the Board is
<br />hereby ordered to give notice by two weekly publications of
<br />the time and place of hearing of this resolution.

<br />IMPROVEMENT RESOLUTION NO. 3263, 1968 (AMENDED) - 35TH STREET
<br />Upon motion made, seconded and unanimously carried, Improvement
<br />Resolution No. 3263, 1968, being for the improvement of 35th Street
<br />from Jefferson Boulevard to the railroad south of Jefferson by con-
<br />structing a Class C pavement with curb repair, was amended to read
<br />as follows:

<br />BE IT RESOLVED, by the Board of Public Works and
<br />Safety of the City of South Bend, Indiana, that it is deemed neces-
<br />sary to improve 35th Street, from Jefferson Boulevard to the
<br />railroad south of Jefferson by constructing a Class C pavement
<br />with curb repair.
<br />The same to be done in accordance with the pro-
<br />files, drawings, plans, general details and specifications
<br />for such improvement approved September 23, 1968, and to be
<br />adopted by the Board of Public Works and Safety of the City
<br />of South Bend, Indiana, immediately upon the final adoption
<br />and confirmation of this resolution, and placed on file in
<br />the office of the Board of Public Works and Safety of said
<br />City, and such improvement is now ordered.
<br />The total cost of said improvement, including
<br />all incidental costs such as advertising, abstracting,
<br />inspection and engineering, shall be assessed upon the real
<br />estate abutting on said 35th Street to be improved, all
<br />according to the method and manner provided for in an Act
<br />of the General Assembly of the State of Indiana, entitled
<br />"An Act Concerning Municipal Corporations" approved March 6,
<br />1905, and an Act of the General Assembly of the State of
<br />Indiana entitled "An Act Concerning Municipal Corporations"
<br />approved February 27, 1953, and in accordance with and pur-
<br />suant to the provisions of all Amendatory and Supplemental
<br />Acts thereto passed by the General Assembly of the State of
<br />Indiana. Assessments, if deferred, are to be paid in five (5)
<br />equal installments, with interest at the rate of six percent (6%)
<br />per annum. Assessments, either cash or defeored, and such
<br />costs as said City is by said entitled Acts and provisions
<br />of all Acts amendatory and supplemental thereto required
<br />to pay, shall be paid into the General Improvement Fund
<br />of the City of South Bend, Indiana. All costs in making
<br />of said improvement shall be paid from said General Improve-
<br />ment Fund. All proceedings had and work done in making of
<br />said improvement, assessment of property, collection of
<br />assessments and issuance of bonds therefor, shall be as pro-
<br />vided for in said entitled Act and amendments thereto..
<br />The 28th day of May, 1969, at the hour of 7:30
<br />o'clock, P.M., local time, is hereby f.ixed as the time and
<br />the office of the Board in said city as the place when and
<br />where all persons whose property may be affected by such
<br />proposed improvement may be heard as to the necessity of
<br />same, and all petitions and remonstrances received, and
