5/5/69 <br />IMPROVEMENT RESOLUTION NO, 3266, 1968 (AMENDED) - SANCOME AVENUE <br />Upon motion made, seconded and unan"imously carried, Improvement Resolution <br />No. 3266, 1968, being for the improvement of Sancome Avenue, from LaPorte <br />to Lincolnway:-,West, by 'constructing a Class C pavement with curb repair, <br />was amended to read as follows: <br />"BE IT RESOLVED, by the Board of Public Works <br />and Safety of the City of South Bend, Indiana, that it is <br />deemed necessary to improve Sancome Avenue, from LaPorte to <br />Lincolnway-West, by constructing a Class C pavement with curb <br />repair. <br />The same to be done in accordance with the pro- <br />files, drawings, plans, general details and specifications for <br />such improvement approved September 3, 1968, and to be adopted <br />by the Board of Public Works and Safety of the City of South <br />Bend, Indiana, immediately upon the final adoption and con- <br />firmation of this resolution, and placed on file in the office <br />of the Board of Public Works and Safety of said City, and such <br />improvement is now ordered. <br />~" <br />The total cost of said improvement, including all <br />incidental costs such as advertising, abstracting inspection <br />and engineering, shall be assessed upon the real estate abutting <br />on said Sancome Avenue to be improved, all according to the <br />method and manner provided for in an Act of the General Assembly <br />of the State of Indiana, entitled "An Act Concerning Municipal <br />Corporations" approved March 6, 1905, and an Act of the General <br />Assembly of the State of Indiana entitled "An Act Concerning <br />Municipal Corporations" approved February 27, 1953, and in accord- <br />ance with and pursuant to the provisions of all Amendatory and <br />Supplemental Acts thereto passed by the General Assembly of the <br />State of Indiana. Assessments, if deferred, are to be paid in <br />five (5) equal installments, with interest at the rate of six <br />percent (6%) per annum. Assessments, either cash or deferred, <br />and such costs as said City is by said entitled Acts and provisions <br />of all Acts amendatory and supplemental thereto required to pay <br />shall be paid into the General Improvement Fund of the City of South <br />Bend, Indiana. All costs in making said improvement shall be <br />paid from said General Improvement Fund. All proceedings had <br />and work done in making of said improvements, assessment of <br />property, collection of assessments and issuance of bonds there- <br />for shall be provided for in said entitled Act and amendments <br />thereto. <br />The 28th day of May, 1969, at the hour of 7:30 <br />o'clock, P.M., local time, is hereby fixed as the time and the <br />office of the Board in said City as the place when and where all <br />persons whose property may be affected by such proposed improve- <br />ment may be heard as to the necessity for the same and all <br />petitions and remonstrances received and the Board will on said <br />day decide whether the benefits accruing to abutting and adjacent <br />property and to the City of South Bend, Indiana, will be equal <br />to or exceed the estimated cost of said improvement. The Clerk <br />of the Board is hereby ordered to give notice by two weekly <br />publications of the time and place of hearing of this resolution. <br />Adopted May 5, 1969. <br />L. S. Bickel it <br />IMPROVEMENT RESOLUTION MO. 3267, 1968 (AMENDED) - WEST CALVERT STREET <br />Upon motion made, seconded and unanimously carried, Improvement Resolution <br />No. 3267, 1968, being for the improvement of West Calvert Street, from <br />Pulaski to Brookfield, by constructing a Class C pavement with curb repair. <br />The same to be done in accordance with the profiles, <br />drawings, plans, general details and specifications for such improvement <br />approved February 3, 1969, and to be adopted by the Board of Public Works <br />and Safety of the City of South Bend, Indiana, immediately upon the final <br />
