<br />shall be paid into the General Improvement Fund of the City of South
<br />Bend, Indiana. All costs in making of said improvement shall be paid
<br />from said General Improvement Fund. All proceedings had and work done
<br />in making of said improvement, assessment of property,. collection of
<br />assessments and issuance of bonds therefor shall be as provided for in
<br />said entitled Act and amendments thereto.
<br />The 28th day of.May, 1969, at the hour of 7:30 o'clock,
<br />P.M., locat time, is hereby fixed as the time and the office of the Board
<br />in said City as the place when and where all persons whose property
<br />may be affected by such proposed improvement may be heard as to the
<br />necessity for the same,,and all petitions and remonstrances received,
<br />and the Board will on said day decide whether the benefits accruing to
<br />abutting and adjacent property and to the city of South Bend, Indiana,
<br />will be equal to or exceed the estimated cost of said improvement. The
<br />Clerk of the Board is hereby ordered to give notoce by two weekly publi-
<br />cations of the time and place of hearing of this resolution.

<br />IMPROVEMENT RESOLUTION NO. 326o, 1968 (AMENDED) - 33RD STREET
<br />Upon motion made, seconded and unanimously carried, Improvement Resolution
<br />No. 3260, 1968, being for the improvement of 33rd Street, from Pleasant
<br />Street to North Side Boulevard, by constructing a Class C pavement with
<br />curb repair, was amended to read as follows:
<br />"BE IT RESOLVED, by the Board of Public Works and Safety
<br />of the City of South Bend, Indian@, that it is deemed necessary to
<br />improve 33rd Street from Pleasant Street to North Side Boulevard
<br />by constructing a Class C pavement with curb repair.
<br />The same to be done in accordance with the profiles,
<br />drawings, plans, general details and specifications for such
<br />improvement approved September 23, 1968, and to be adopted by
<br />the Board of Public Works and Safety of the City of South Bend,
<br />Indiana, immediately upon the final adoption and confirmation
<br />of this resolution, and placed on file in the office of the
<br />Board 6f Public Works and Safety of said City, and such improve-
<br />ment is now ordered.
<br />The total cost of said improvement, including all
<br />incidental costs such as advertising, abstracting, inspection
<br />and engineering, shall be assessed upon the real estate abutting
<br />on said 33rd Street to be improved, all according to the method
<br />and manner provided for in an Act of the General Assembly of the
<br />State of Indiana, entitled, "An Act concerning Municipal Corpora-
<br />tions" approved March 6, 1905, and an Act of the General Assembly
<br />of the State of Indiana entitled "An Act Concerning Municipal
<br />Corporations" approved February 27, 1953, and in accordance with
<br />and pursuant to the provisions of all Amendatory and Supplemental
<br />Acts thereto, passed by the General Assembly of the State of Indiana.
<br />Assessments, if deferred, are to be paid in five (5) equal install-
<br />ments, with interest at the rate of six percent (6%) per annum.
<br />Assessments, either cash or deferred, and such costs as said City
<br />is by said entitled Acts and provisions of all Acts amendatory
<br />and supplemental thereto required to pay shall be paid into the
<br />General Improvement Fund of the City of South Bend, Indiana. All
<br />costs in making of said improvement shall be paid from said Gene al
<br />Improvement Fund. All proceedings had and work done in making of
