1112 <br />5/5/69 <br />adoption and confirmation of this resolution and placed on file <br />in the office of the Board of Public Works and Safety of said City, <br />and such improvement is now ordered. <br />The total cost of said improvement, including <br />all incidental costs such as advertising, abstracting, inspection <br />and engineering, shall be assessed upon the real estate abutting <br />on said West Calvert Street to be improved, all according to the <br />method and manner provided for in an Act of the General Assembly <br />of the State of Indiana, entitled "An Act Concerning Municipal <br />Corporations" approved March 6, 1905, and an Act of the General <br />Assembly of the State of Indiana, entitled "An Act Concerning <br />Municipal Corporations" approved February 27, 1953, and in accord- <br />ance with and pursuant to the provisions of all Amendatory and <br />Supplemental Acts thereto passed by the General Assembly of the <br />State of Indiana. Assessments, if deferred, are to be paid in <br />five (5) equal installments, with interest at the rate of six per- <br />cent (6%) per annum. Assessments, either cash or deferred, and <br />such costs as said City is by said entitled Acts and provisions of <br />all Acts amendatory and supplemental thereto, required to pay, <br />shall be paid into the General Improvement Fund of the City of <br />South Bend, Indiana. All costs in making of said improvement <br />shall be paid from said General Improvement Fund. All proceedings <br />had and work done in making of said improvement, assessment of <br />property, collection of assessments and issuance of bonds therefor <br />shall be as provided for in said entitled Act and amendments thereto. <br />The 28th day of May, 1969, at the hour of 7:30 <br />o'clock, P.M., local time, is hereby fixed as the time and the <br />office of the Board in said City as the place, when and where all <br />persons whose property may be affected by such proposed improvement <br />may be heard as to the necessity for the same, and all petitions <br />and remonstrances received and the Board will on said day decide <br />whether the benefits accruing to abutting and adjacent property <br />and to the City of South Bend, Indiana, will be equal to or exceed <br />the estimated cost of said improvement. Bickel <br />BOARD OF PUBLIC WORKS & SAFETY" <br />IMPROVEMENT RESOLUTION NO. 3268, 1968 (AMENDED) - WALSH STREET <br />Upon motion made, seconded and unanimously carried, Improvement Resolution No. <br />3268, 1968, being for the improvement of Walsh Street, from Chalfant to Sorin, <br />by constructing a Class C pavement with curbs, was amended to read as follows: <br />"BE IT RESOLVED, by the Board of Public Works and Safety of the <br />City of South Bend, Indiana, that it is deemed necessary to im- <br />prove Walsh Street, from Cahlfant to Sorin, by constructing a`.;Class <br />C pavement with curbs. <br />The same to be done in accordance with the profiles, <br />drawings, plans, general details and specifications for such improvement <br />approved February 3, 1969, and to be adopted by the Board pf Public <br />Works and Safety of the City of South Bend, Indiana, immediately upon <br />the final adoption and confirmation of this resolution and placed on <br />file in the office of the Board of Public Works and Safety of said City, <br />and such improvement is now ordered. <br />The total cost of said improvement, including all <br />incidental costs such as advertising, abstracting, inspection and <br />engineering, shall be assessed upon the real estate abutting on said <br />Walsh Street to be improved, all according to the method and manner <br />provided for in an Act of the General Assembly of the State of <br />Indiana, entitled "An Act Concerning Municipal Corporations" approved <br />March 6, 1905, and an Act of the General Assembly of the State of <br />Indiana entitled "An Act Concerning Municipal Corporations" approved <br />
