<br />HEARING ON VACATION RESOLUTION NO. 3272 - STATE WIDE ALUMINUM PRODUCTS
<br />This being the date set, hearing was held on Vacation Resolution No. 3272
<br />adopted on the 20th day of January, 1969, for the vacation of all of that
<br />part of the right of way/ of Fairview Avenue from the west line of Main
<br />Street to the east right of way line of Penn -Central.
<br />Proofs:. -of publication in the South Bend Tribune and Tri-County News on
<br />January 24 and January 31, 1969, were tendered by the Clerk and found to be
<br />sufficient.
<br />Attorney Joseph A. Roper appeared before the Board on behalf of the
<br />petitioners. Earl R. Hite, 2615 S. Main Street, South Bend, and two other
<br />interested property owners also appeared before the Board.
<br />Mr. Hite stated that he lives on the fi-rst"alley south of Fairview on the
<br />west side of the street; that he would have no objection to the vacation if
<br />trash haulers and garbage collectors can get through without going right
<br />by his house. The other property owners voiced the same concern. It was
<br />explained by Mr. Taylor that the petitioners have agreed to provide an ease-
<br />ment according to drawing submitted, which was examined. Mr. Hite and the
<br />other property .owners then stated they would have no objection to the vacation.

<br />The question was asked as to whose responsibility it would be to provide
<br />gravel. The City Engineer stated the'ditch would be relocated or straightened
<br />by the petitioner a°nd petitioner would be required to put the area in shape
<br />for use so that there will be an entrance.
<br />Upon motion made, seconded and carried, the vacation was approved subject to
<br />compliance by the petitioner with the recommendation of the Area Plan
<br />Commission and with the further stipulation that the petitioner provide an-a._,.��
<br />c,i, ,-O, appropriate curb cut and suitable gravel surface for the easement in con-
<br />formance with the letter of attorney Joseph A; Roper to the Board of Public
<br />Works and Safety under date of January 21, 1969.
<br />BUILDING DEPARTMENT-- SUB -STANDARDS DIVISION
<br />Mr. J. W. Adamson, Sub -Standards Director, appeared before the Board and the
<br />following matters were taken up:
<br />1110 N. Olive Street. Mr. Adamson stated that this building is open, is in
<br />bad repair and should be taken down. Walter R. Nicely, R. R. #2, Buchanan,
<br />Michigan and Mrs. Gizella Kinzalov, 209 S. Kaley Street, South Bend, Indiana,
<br />owners of the property, appeared before the Board. Mr. Nicely spoke on
<br />behalf of the owners. He stated that the building was old and agreed that it
<br />should be torn down and was willing for the City to do so. Mr. Taylor, City
<br />Engineer, explained the procedure for the City to demolish the structure, and
<br />Mr. Nicely stated he understood that the cost of demolition by the City would
<br />constitute a lien against the property.
<br />Thereupon, on motion made, seconded and unanimously carried, the Board authorized
<br />Mr. Adamson to advertise for bids for demolition of the building.
<br />1627 S. Carlisle Street. This being the date set, bids for demolition of this
<br />property were called for. The only bid .received was from Bryant Excavating
<br />Company, South Bend, Indiana, which was opened. Non collusion affidavit was
<br />found to be -proper. -Bid was in the amount of $435.00 including water shut-off.
<br />Upon motion made, seconded and unanimously carried, contract for demolition
<br />of the structure was awarded to Bryant Excavating Company, this bid appearing
<br />to be reasonable and the only bid received.
<br />2225 W. Washington Street. Mr. Adamson reported that the emergency demolition
<br />of this property as requested January 27, 1969, had been accomplished.
<br />RE: CLIFTON LEE; DEMOLITION CONTRACTOR
<br />Mr. Adamson reported he had contacted the office of Shanahan & Company, bond
<br />holder for Clifton Lee, to whom demolition contracts had been awarded but
<br />demolition had not been completed, but had not yet received a reply. The
<br />matter was continued to February 10, 1969.
