I <br />5/10/71 <br />ASSESSMENT ROLL FILED - VACATION RESOLUTION NO. 3338 1971 - FRANK J. MORROW <br />Lloyd S. Taylor, City Engineer, files assessment roll showing the award of <br />damages and assessment of benefits in Vacation Resolution No. 3338, 1971, for <br />the vacation of: <br />The east -west alley running between Lots 56 and 57 in <br />Berner's Grove First Addition. Said alley being the first <br />east -west alley north of Mishawaka Avenue and running <br />from the west line of 24th Street to the east line of the <br />first north -south alley west of 24th Street. <br />Reserving the rights and easements of all Utilities and the <br />Municipal City of South Bend, Indiana, to construct and main- <br />tain any facilities, including, but not limited to, the <br />following: electric, telephone, gas, water, sewer, surface <br />water control structures and ditches, within the vacated <br />right of way, unless such rights are released by the <br />individual Utilities. <br />The following property may be injuriously or beneficially affected by such <br />vacation: <br />Lots 56 and 57 of Berner's Grove First Addition. <br />Net damages $00.00 <br />Net benefits $00.00 <br />Upon motion made, seconded and unanimously carried, the Board adopted said <br />Assessment Roll and set 9:30 A.M. on June 1, 1971, in Room 1308 County City <br />Building, South Bend, Indiana, as the time and place for hearing all persons <br />Interested in or affected by said vacation. The Clerk is directed to give <br />notice of such hearing by publication in the South Bend Tribune and the Tri <br />County News on May 14, May 21 and May 28, 1971. <br />HEARING ON ASSESSMENT ROLL - VACATION RESOLUTION NO. 3264, 1968 IRVING J. <br />SMITH <br />This being the date set, hearing was held on the assessment roll in Vacation <br />Resolution No. 3264, 1968 for the vacation of: <br />The east -west alley south of Washington Avenue between St. <br />Peter Street and Notre Dame Avenue running west from Notre <br />Dame Avenue to the first north -south alley. Also, the <br />north -south alley east of St. Peter Street running north <br />from Jefferson Boulevard to the first east -west alley be- <br />tween Jefferson Boulevard and Washington Avenue. <br />The Clerk tendered proofs of publication of notice in the South Bend Tribune <br />and the Tri County News on April 16, April 23 and April 30, 1971, which were <br />read and found to be sufficient. No remonstrators having appeared and no <br />written remonstrances having been received, upon motion made, seconded and <br />unanimously carried, the assessment roll was approved as presented and the <br />resolution in all things ratified and confirmed. <br />PLANS AND SPECIFICATIONS APPROVED FOR PROJECT INDIANA R-66 PHASE I - DEPART - <br />MENT OF REDEVELOPMENT <br />Upon motion made, seconded and unanimously carried, plans and specifications <br />were approved by the Board for Department of Redevelopment Project Indiana R-66, <br />Central Downtown Renewal Project, Phase I, as submitted by Clyde E. Williams <br />and Associates, Inc. <br />ALLEY BLOCKED AT SITE OF INDIANA BELL TELEPHONE COMPANY CONSTRUCTION SITE <br />Attorney Louis Anderson, 200 Law Building, South Bend, Indiana and Carl <br />Hibberd appeared before the Board in reference to the blocking of the alley <br />at the construction site of the Indiana Bell Telephone Company building. <br />Mr. Anderson stated the closing of the alley blocked the use of a loading <br />dock to the building owned by Mr. Hibbero. Mr. Anderson was advised no permit <br />had been granted for the closing of the alley but that there was no way to <br />
