5/6/71 <br />REQUEST TO`TRANSFER FUNDS --SANITATION DEPARTMENT <br />Upon motion made, seconded and unanimously carried, the Board approved the <br />request of the City Engineer to transfer funds in the Sanitation Department, <br />as follows -- <br />From Acct. XX-261 (other contractual services) ------------ $22,800.00 <br />To: Acct. XX-12 (temporary help)------------ $20,000.00 <br />XX-215 (transportation allowance)-- 550.00 <br />XX-37 (other supplies) ----------- 500.00 <br />XX-722 (motor equipment)----------- 1,750.00 <br />$22,800.00 <br />for the purpose of creating and putting into effect a program for trash <br />disposal. It was further moved, seconded and unanimously carried that the <br />matter be referred to the Legal Department for the preparation of an ordinance <br />for the consideration of the Common -Council. <br />HEARING ON VACATION RESOLUTION NO. 3338 - FRANK J. MORROW <br />This being the date set for preliminary hearing on Vacation Resolution No. <br />3338 for the vacation of: <br />The east -west alley running between Lots 56 and 57 in Berner's <br />Grove First Addition. Said alley baring the first east -west alley <br />north of Mishawaka Avenue and running from the west line of 24th <br />Street to the east line of the first north -south alley west of <br />24th Street. <br />the Clerk tendered proofs of publication of notice in the South Bend Tribune <br />and the Tri County News on April 23 and April 30, 1971, which were found to <br />be sufficient. <br />The petitioner, Frank J. Morrow, and his attorney Arthur J. Frisk appeared <br />before the Board. <br />Mr. Frisk stated Mr. and Mrs. Frank J. Morrow own the restaurant at <br />2323 Mishawaka Avenue and it is desirable to have the alley vacated for <br />better parking facilities for the restaurant and future possibility of en- <br />largement of the restaurant. <br />Letters were read from Dorsey H. King, 12117 Margareta Drive, Venice Florida, <br />Joseph W. and Sylvia L. Daniels, 592 Rockport Drive, Sunnyvale, California, <br />Winnifred McCann, 819 24th Street, South Bend, Indiana, and Bruce H. and <br />Evelyn B. Yundt, 821 24th Street, South Bend, Indiana, having no objection <br />to the vacation. <br />No remonstrators having appeared and no written remonstrances having been <br />received, upon motion made, seconded and unanimously carried said Resolution <br />was ratified and confirmed as adopted. The City Engineer was directed to pre- <br />pare an assessment roll showing the assessment of benefits and the award of <br />damages to the surrounding properties. <br />REQUEST TO VACATE ALLEY - ANTHONY J. PANZICA <br />Anthony J. Panzica, 1242 Mishawaka Avenue, South Bend, Indiana, files with <br />the Board his request to vacate the north south alley between 24th and <br />25th Streets, at Mishawaka Avenue. Upon motion made, seconded and carried, <br />the request was referred to the Engineering Department and the Area Plan <br />Commission, simultaneously, for study and recommendation to the Board. <br />REQUEST TO HOLD DEMONSTRATION - "THE AMERICAN INDIAN" <br />Michael Ferrill, 1022 Foster Street, South Bend, Indiana, Holy Cross Jr. <br />College student, appeared before the Board and requested permission to hold <br />a "demonstration" on the sidewalk in front of the County City Building on <br />May 6, 1971, and was advised that no permission was required from the Board <br />of Public Works and Safety providing they did not block the sidewalk and <br />the demonstration peacable. <br />PARADE REQUEST - CHET WAGGONER LITTLE LEAGUE <br />Upon motion made, seconded and unanimously carried, the Board approved the <br />
