3 3 C7, 3/8/71. HEARING ON VACATION RESOLUTION NO. 3336 - NATHAN LERMAN EGAT ION - This being the date set, hearing was held on Resolution No. 3336, 1971 for the vacation of: the east -west alley between Tasher Avenue and Jennings Avenue from the east line of Lot 19 to the west line of Lot 27 in Crestview First Addition. Also, Jennings Avenue from the east line of Lot 19 to the west line of Lot 27 in Crestview First Addition. Proofs of publication°in the South Bend Tribune and the Tri County News on February 26 and March'5, 1971, were found to be proper. Louis Chapleau, attorney for the petitioner, 316 First Bank Building, South Bend, Indiana, and Mrs. Victor Kuzmic, 119 W. 16th Street, Mishawaka, Indiana, appeared before the Board. Following a discussion concerning the vacation of Tasher Avenue and the north -south alley as petitioned, Nr. Chapleau affirmed the understanding that only Jennings Avenue and the east west alley as petitioned are to be considered for vacation under Resolution No. 3336. Mrs. Kuzmic stated she bas no objection to the vacation. No remonstrances having been received and no one further appearing either for or against said vacation, it was moved, seconded and unanimously carried that Vacation Resolution No. 3336, 1971 adopted February 22, 1971, be ratified and confirmed and the property vacated. The City Engineer is directed to prepare an'assessment roll covering the assessment of benefits and the award of damages to the surrounding properties. HEARING ON VACATION RESOLUTION NO. 3337 - DEPARTMENT OF -REDEVELOPMENT NEW POST OFF I'CE SITE) This being the date set, hearing was had on Resolution No. 3337, 1971, for the vacation of: A part of the west Half of Section 12, Township 37 north, Range 2 east, City of South Bend, St. Joseph County, Indiana, described as follows: Beginning at the intersection of the east boundary of S..Michigan Street (U. S. R. 31) and the north boundary of E. Monroe Street; thence north 0 degrees 29 minutes 07 seconds west 42.33 feet along said east boundary; thence northeasterly 381.53 feet along an arc to the right and having a radius of 624.57 feet and subtended by a long chord having a bearing of north 17 degrees 00 minutes 53 seconds east and a length of 375.62 feet; thence north 34 degrees 30 minutes 53.seconds east 9.47 feet to the south boundary of E. Western Avenue; thence north 89 degrees 37 minutes 15 seconds east 309.62 feet along said south boundary; thence northeasterly-253.74 feet along an arc to the left and having a radius of 424.47 feet and subtended by a long chord -having a bearing of north 72 degrees 29 minutes 46 seconds east and a length of 249.47 feet; thence north 56 degrees 45 minutes 30 seconds east 119.43 feet; thence south 56 degrees 36 n4nutes 16 seconds east 123.03 feet; thence southeasterly 335.73 feet along an arc to the right and having a radius of 341.97 feet and subtended by a long chord having a bearing of south 28 degrees 28 minutes 47 seconds east and a length of 322.41 feet; thence south. 0 degrees 21 minutes 18 seconds east 194.58 feet to the north boundary of east Monroe Street; thence south 89 degrees 38 minutes 42 sec- onds west 1,020.50 feet along said north boundary to the point of beginning and containing 428,210 square feet or 9,830 acres, more or less. 1
