23 _' 1 <br />2/22/71 <br />The Clerk tendered proofs of publication of notice in the South Bend Tribune <br />and the Tri County News on February 12 and February 19, 1971, which were <br />found to be proper. No remonstrators appeared and no written remonstrances <br />were received. Upon motion made, seconded and unanimously carried, the <br />Resolution was ratified and confirmed. And the City Engineer was directed <br />to prepare an assessment roll covering the assessment of benefits and the <br />award of damages to surrounding property owners. <br />HEARING ON VACATION RESOLUTION NO. 3335, 1971 - MARIE J. PFEIL <br />This being the date set, heating was held on Vacation Resolution No. 3335, <br />1971 for the vacation of <br />The first east -west alley between Navarre and Marion Streets <br />from Michigan Street east 165 feet to the first -north -south <br />alley. The alley to be vacated is between Lots 126 and 127 in <br />the original plat of South Bend. <br />The Clerk tendered proofs of publication in the South Bend Tribune and the <br />�...I Tri County News on February 12 and February 19, 1971, which were found to <br />�p be proper. <br />lfr <br />Ajax Arvin appeared on behalf of the petitioners Marie J. Pfeil and Charles <br />D. Hills. No other persons appeared for or against the vacation. No <br />remonstrators having appeared and no written remonstrances having been re- <br />ceived, upon motion made, seconded and unanimously carried, the resolution <br />adopted February 8, 1971, was ratified and confirmed. And the City Engineer <br />was directed to prepare an assessment roll covering the assessment of <br />benefits and the award of damages to surrounding property owners. <br />REQUEST TO ATTEND FUNERAL OF STATE TROOPER JOHN STREU <br />Upon motion made, seconded and unanimously carried, the Board approved the <br />request of Assistant Chief Kenneth McDonald to send an honor guard to <br />Logansport, Indiana, to attend the funeral of State Trooper John Streu <br />February 23, 1971, who was killed in the line of duty, and to use a Police <br />Department vehicle for transportation. <br />AREA PLAN COMMISSION RECOMMENDATION AND <br />ADOPTION OF VACATION RESOLUTION NO. 3336, 1971 - NATHAN LERMAN <br />Area Plan Commission files with the Board its recommendation that Jennings <br />Avenue and the alley north and parallel to Jennings Avenue be vacated, but <br />that Tasher Avenue remain a publicly dedicated thoroughfare until other <br />means of access is provided for Lot No. 5 in Crestview Second Addition. <br />Upon motion made, seconded and unanimously carried, the following resolution <br />was adopted: <br />"VACATION RESOLUTION NO. 3336, 1971 <br />"RESOLVED BY THE BOARD OF PUBLIC WORKS AND SAFETY OF <br />THE CITY OF SOUTH BEND, INDIANA, That it is desirable to vacate the <br />following: <br />The east -west alley between Tasher Avenue and Jennings <br />Avenue from the east line of Lot 19 to the west line of <br />Lot 27 in Crestview First Addition. <br />Also, Jennings Avenue from the east line of Lot 19 to the <br />west line of Lot 27 in Crestview First Addition. <br />Reserving the rights and easement-s of all utilities and <br />the municipal city of South Bend, Indiana, to construct and main- <br />tain any facilities, including, but not limited to, the following: <br />electric, telephone, gas, water, sewer, surface water control <br />structures and ditches, within the,vacated right of way, unless <br />such rights are released by the individual utilities. <br />
