2/8/71 <br />Beginning at a point on the south line of Rose Street, <br />which is 272.45 feet west of the west line of Riverside . <br />Drive, said point being on the -centerline of a 14 foot alley; <br />thence south 900 00" 00" west, a distance of 62.00 feet to <br />the P.C. of a 50 foot radius curve to the right; thence on <br />and along said 50 foot radius curve to the right through a <br />cebtral angle of 2330 26' 25", a chord length of 92:90 feet, <br />a chord bearing of north 210 43' 13" east and an arc distance <br />of 194.99 feet to the P.T. of said 50' radius curve to the <br />right; thence south 460 33' 35" east, a distance of 38.26 <br />feet to the intersection of the north line of Rose Street <br />with the centerline of the aforesaid 14 foot alley; thence <br />south 000 09' 00" west, a distance of 60.00 feet to the <br />place of beginning. <br />be _approved and that Vacation Resolution No. 3280 for the vacation of <br />portions of Rose Street and two alleys be finally ratified and confirmed <br />and the property vacated. <br />AREA PLAN RECOMMENDATION AND ADOPTION OF VACATION RESOLUTION NO. 3334, 1971 - <br />JOHN C. PERRY <br />Area Plan Commission recommends favor-a-b.ly t.he. vacation of the east west <br />alley between Dubail Avenue and Calvert Street, in the city of South Bend, <br />Indiana, upon the petition of John C. Perry. <br />Upon motion made, seconded and unanimously carried, the following Resolution <br />was adopted: <br />"VACATION RESOLUTION NO. 3334, 1971 <br />"RESOLVED BY THE BOARD OF PUBLIC WORKS AND SAFETY OF <br />THE CITY OF SOUTH BEND, INDIANA, That it is desirable to vacate <br />the following: - <br />The east -west alley between Dubail Avenue and Calvert <br />Street from the east right of way line of Grant Street <br />to the west right of way line of the north south alley <br />between Dubail and Calvert Street, and from the east <br />right of way line of the said north -south alley to the <br />west right of way line of Brookfield Street, situated <br />in Whiteman's First Addition. <br />Reserving the rights and easements of all utilities and <br />the Municipal City of South Bend, Indiana, -to construct and maintain <br />any facilities, including, but not limited to, the following: <br />electric, telephone, gas, water, sewer, surface water control <br />structures and ditches within the vacated right of way unless such <br />rights are released by the individual utilities. <br />The following property may be injuriously or beneficially <br />affected by such vacation: <br />Lots numbered 76, 77, 122 and 123 in Whiteman's First <br />Addition. <br />Notice of this Resolution shall be published on the 12th <br />day of February, 1971 and the 19th day of February, 1971, in the <br />South Bend Tribune and the Tri County News. <br />This Board, at its office, on the 22nd day of February, <br />1971, at 9:30 o'clock, A.M., will hear and receive remonstrances <br />from all persons interested in or affected by these proceedings. <br />Adopted this 8th day of February, 1971. <br />BOARD OF PUBLIC WORKS AND SAFETY <br />Lloyd S.
