2/8/71 Beginning at a point on the south line of Rose Street, which is 272.45 feet west of the west line of Riverside . Drive, said point being on the -centerline of a 14 foot alley; thence south 900 00" 00" west, a distance of 62.00 feet to the P.C. of a 50 foot radius curve to the right; thence on and along said 50 foot radius curve to the right through a cebtral angle of 2330 26' 25", a chord length of 92:90 feet, a chord bearing of north 210 43' 13" east and an arc distance of 194.99 feet to the P.T. of said 50' radius curve to the right; thence south 460 33' 35" east, a distance of 38.26 feet to the intersection of the north line of Rose Street with the centerline of the aforesaid 14 foot alley; thence south 000 09' 00" west, a distance of 60.00 feet to the place of beginning. be _approved and that Vacation Resolution No. 3280 for the vacation of portions of Rose Street and two alleys be finally ratified and confirmed and the property vacated. AREA PLAN RECOMMENDATION AND ADOPTION OF VACATION RESOLUTION NO. 3334, 1971 - JOHN C. PERRY Area Plan Commission recommends favor-a-b.ly t.he. vacation of the east west alley between Dubail Avenue and Calvert Street, in the city of South Bend, Indiana, upon the petition of John C. Perry. Upon motion made, seconded and unanimously carried, the following Resolution was adopted: "VACATION RESOLUTION NO. 3334, 1971 "RESOLVED BY THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF SOUTH BEND, INDIANA, That it is desirable to vacate the following: - The east -west alley between Dubail Avenue and Calvert Street from the east right of way line of Grant Street to the west right of way line of the north south alley between Dubail and Calvert Street, and from the east right of way line of the said north -south alley to the west right of way line of Brookfield Street, situated in Whiteman's First Addition. Reserving the rights and easements of all utilities and the Municipal City of South Bend, Indiana, -to construct and maintain any facilities, including, but not limited to, the following: electric, telephone, gas, water, sewer, surface water control structures and ditches within the vacated right of way unless such rights are released by the individual utilities. The following property may be injuriously or beneficially affected by such vacation: Lots numbered 76, 77, 122 and 123 in Whiteman's First Addition. Notice of this Resolution shall be published on the 12th day of February, 1971 and the 19th day of February, 1971, in the South Bend Tribune and the Tri County News. This Board, at its office, on the 22nd day of February, 1971, at 9:30 o'clock, A.M., will hear and receive remonstrances from all persons interested in or affected by these proceedings.
