Taylor, City Engineer, files assessment roll showing award of damages <br />and assessment of benefits in Vacation Resolution No. 3331, 1970, for the <br />vacation of: <br />Portions of streets and alleys, all within the recorded <br />plat of Raff's First Addition, Raff's Second Addition and <br />Lewis' First Addition Subdivisions in the northeast Quarter <br />of Section 14, Township 37 north, Range 2 east, as follows: <br />(1) Leon Court, an east -west street from the east line of <br />Kemble Avenue to the west line of Kendall Street <br />(38,096 sq. ft.); <br />(2) Catalpa Avenue, a north -south street, from the south <br />line of Cotter Street to the north line of Leon Court <br />(9,960 sq. ft.); <br />(3) Catalpa Avenue, a north -south street, from the south <br />line of Leon Court south 225 feet (9,000 sq. ft.); <br />(4) Chapin Street, a north -south street, from the south <br />line of Cotter Street to the north line of Leon Court <br />(9,960 sq. ft.); <br />(5) Chapin Street, a north -south street, from the south <br />line of Leon Court south 225 feet (9,000 sq. ft.); <br />(6) The north -south alley between Prairie Avenue and <br />Catalpa Avenue, from the south line of Cotter Street <br />to the north line of Leon Court'(3,486 sq. ft.); <br />(7) The north -south alley between Catalpa Avenue and Chapin <br />Street from the south line of Cotter Street to the <br />north line of Leon Court (3,486 sq. ft.); <br />f8) The north -south alley between Catalpa Avenue and Chapin <br />Street from the south line of Leon Court south 225 <br />feet (3,150 sq. ft.); <br />(9) The north -;south alley between Chapin Street and Kendall <br />Street from the south line of Cotter Street to the north <br />line of Leon Court (3,486 sq. ft.); and <br />(10) The north -south alley between Chapin Street and Kendall <br />Street from the south line of Leon Court south 225 feet <br />(3,150 sq. ft.). <br />Reserving the rights and easements of all utilities and the <br />Municipal City of South Bend, Indiana, to construct and maintain <br />any facilities, including but not limited to electric, telephone, <br />gas, water, sewer, surface water control structures and ditches <br />within the vacated right of way unless such rights are released <br />by the individual utilities. <br />The following property may be injuriously or beneficially affected <br />by such vacation: <br />The area bounded on the east by Kemble Avenue and Prairie <br />Avenue, on the south by Cotter Street, on the west by Kendall <br />Avenue and on the north by Penn Central and New Jersey, <br />Indiana and Illinois Railroad Company. <br />Total net damages $00.00 <br />Total net benefits $00.00 <br />Lloyd S. And the Clerk is directed to give notice of such hearing <br />by publication in the South Bend Tribune and the Tri County News on January 1, <br />January 8 and January 15, 1971. <br />
