12/28/70 ASSESSMENT ROLL FILED - VACATION RESOLUTION NO. 3331, 1970 - DEPARTMENT OF REDEVELOPMENT Lloyd S. Taylor, City Engineer, files assessment roll showing award of damages and assessment of benefits in Vacation Resolution No. 3331, 1970, for the vacation of: Portions of streets and alleys, all within the recorded plat of Raff's First Addition, Raff's Second Addition and Lewis' First Addition Subdivisions in the northeast Quarter of Section 14, Township 37 north, Range 2 east, as follows: (1) Leon Court, an east -west street from the east line of Kemble Avenue to the west line of Kendall Street (38,096 sq. ft.); (2) Catalpa Avenue, a north -south street, from the south line of Cotter Street to the north line of Leon Court (9,960 sq. ft.); (3) Catalpa Avenue, a north -south street, from the south line of Leon Court south 225 feet (9,000 sq. ft.); (4) Chapin Street, a north -south street, from the south line of Cotter Street to the north line of Leon Court (9,960 sq. ft.); (5) Chapin Street, a north -south street, from the south line of Leon Court south 225 feet (9,000 sq. ft.); (6) The north -south alley between Prairie Avenue and Catalpa Avenue, from the south line of Cotter Street to the north line of Leon Court'(3,486 sq. ft.); (7) The north -south alley between Catalpa Avenue and Chapin Street from the south line of Cotter Street to the north line of Leon Court (3,486 sq. ft.); f8) The north -south alley between Catalpa Avenue and Chapin Street from the south line of Leon Court south 225 feet (3,150 sq. ft.); (9) The north -;south alley between Chapin Street and Kendall Street from the south line of Cotter Street to the north line of Leon Court (3,486 sq. ft.); and (10) The north -south alley between Chapin Street and Kendall Street from the south line of Leon Court south 225 feet (3,150 sq. ft.). Reserving the rights and easements of all utilities and the Municipal City of South Bend, Indiana, to construct and maintain any facilities, including but not limited to electric, telephone, gas, water, sewer, surface water control structures and ditches within the vacated right of way unless such rights are released by the individual utilities. The following property may be injuriously or beneficially affected by such vacation: The area bounded on the east by Kemble Avenue and Prairie Avenue, on the south by Cotter Street, on the west by Kendall Avenue and on the north by Penn Central and New Jersey, Indiana and Illinois Railroad Company. Taylor City Civil Engineer And the Board sets January 25, 1971, at 9:30 A.M. as the time for hearing and receiving remonstrances from all persons interested in or affected by such vacation. And the Clerk is directed to give notice of such hearing by publication in the South Bend Tribune and the Tri County News on January 1, January 8 and January 15, 1971.
