" <br />RESOLUTION NO. 11-23-70 ADOPTED - CLYDE CREEK STORM WATER RETENTION BASIN <br />Upon motion made, seconded and unanimously carried, the following <br />Resolution was adopted: <br />"RESOLUTION NO. 1 1-23-70 <br />�0 A RESOLUTION AUTHORIZING THE ACQUISITION OF LAND FOR <br />CONSTRUCTION OF STORM WATER RETENTION BASIN <br />"WHEREAS, the City of South Bend has been mandated by the State <br />of Indiana to separate storm water drainage from its sanitary sewer <br />system by not later than the year 1977; and <br />WHEREAS, the Board of Public Works and Safety -:has employed <br />consultants to make surveys and to determine the most feasible <br />method of accomplishing this end; and <br />WHEREAS, the said consultants have recommended the con- <br />struction of storm water retention basins in and near certain areas <br />of the City as the most feasible and economical method of achieving <br />separation of storm water and sanitary drainage; and <br />r <br />WHEREAS, the Common Council of the'City of South Bend has <br />appropriated funds for the construction of the first four such <br />storm water retention basins; and <br />WHEREAS, certain real estate must be acquired in order to <br />construct such basins; <br />NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works <br />and Safety of the City of South Bend, Indiana: <br />1. That the construction of the storm water retention <br />basin designated #3,and associated facilities,in the Clyde <br />Creek Drainage Basin, is necessary for the health, welfare and <br />safety of the citizens and taxpayers of the City of South Bend, <br />and such basin upon completion would be of public use and benefit. <br />2. That in order to construct same it is necessary to acquire, <br />by purchase, gift or condemnation, the following described real <br />estate: <br />Lots numbered 3, 4, 5, 6, 1 and 2 in Denslow's Plat; <br />Lots numbered 1, 2, 3 and 4 in Martin's Addition; Lots <br />numbered,' 24, 25, 26, 27, 28, 29, 30, 31, 32, 33, 34, <br />35, 36, 37, 89 and 90 in Roseland Park; a 40 ft. x 140 ft. <br />unplatted lot on Randolph Street just east of Martin's <br />Addition; a 115 ft. x 210 ft. unplatted lot between the <br />east -west alley north of Randolph Street and the Penn <br />Central Railway. The west boundary line of the unplatted <br />lot is in alignment with the west property line of <br />Sampson Street. <br />An unplatted area beginning 112.5 feet east from the <br />northeast corner of Robinson and Randolph Streets; <br />thence north approximately 240 feet; thence east <br />approximately 80 feet; thence north approximately <br />
