" RESOLUTION NO. 11-23-70 ADOPTED - CLYDE CREEK STORM WATER RETENTION BASIN Upon motion made, seconded and unanimously carried, the following Resolution was adopted: "RESOLUTION NO. 1 1-23-70 �0 A RESOLUTION AUTHORIZING THE ACQUISITION OF LAND FOR CONSTRUCTION OF STORM WATER RETENTION BASIN "WHEREAS, the City of South Bend has been mandated by the State of Indiana to separate storm water drainage from its sanitary sewer system by not later than the year 1977; and WHEREAS, the Board of Public Works and Safety -:has employed consultants to make surveys and to determine the most feasible method of accomplishing this end; and WHEREAS, the said consultants have recommended the con- struction of storm water retention basins in and near certain areas of the City as the most feasible and economical method of achieving separation of storm water and sanitary drainage; and r WHEREAS, the Common Council of the'City of South Bend has appropriated funds for the construction of the first four such storm water retention basins; and WHEREAS, certain real estate must be acquired in order to construct such basins; NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works and Safety of the City of South Bend, Indiana: 1. That the construction of the storm water retention basin designated #3,and associated facilities,in the Clyde Creek Drainage Basin, is necessary for the health, welfare and safety of the citizens and taxpayers of the City of South Bend, and such basin upon completion would be of public use and benefit. 2. That in order to construct same it is necessary to acquire, by purchase, gift or condemnation, the following described real estate: Lots numbered 3, 4, 5, 6, 1 and 2 in Denslow's Plat; Lots numbered 1, 2, 3 and 4 in Martin's Addition; Lots numbered,' 24, 25, 26, 27, 28, 29, 30, 31, 32, 33, 34, 35, 36, 37, 89 and 90 in Roseland Park; a 40 ft. x 140 ft. unplatted lot on Randolph Street just east of Martin's Addition; a 115 ft. x 210 ft. unplatted lot between the east -west alley north of Randolph Street and the Penn Central Railway. The west boundary line of the unplatted lot is in alignment with the west property line of Sampson Street.
