�`_ <br />11/16/70 <br />CONTRACT AWARDED - LOGAN - 36TH STREETS STORM SEWERS AND LAGOON "K" <br />Charles W. Cole & Son, Inc., consulting engineers, submits to the Board its <br />recommendation for the award of contract for the construction of the Logan - <br />36th Streets sewerand Lagoon "K'' and the Board having considered all bids <br />and being duly advised, upon motion made, seconded and unanimously carried, <br />contract for such construction was awarded to Woodruff & Sons, Inc., on their <br />bid of $248,930.15, that being considered to the best advantage of the City of <br />South Bend. <br />TOPICS(CONTRAeT FILED <br />TOPICS contract, executed by the City of South Bend by and through its Board <br />of Public Works and Safety, by St. Joseph County, Indiana by and through its <br />Board of Commissioners, by Clyde E. Williams and Associates, Inc., consulting <br />engineers, and approved by the Indiana State Highway Commission, as of <br />September 22, 1970, now complete, was ordered filed. <br />(TOPICS program: an urban traffic operations program to increase capacity and <br />safety, authorized under Section 10 of the Federal Aid Highway Act of 1968, <br />approved August 23, 1968, which amended -Chapter 1 of Title 23, U.S. Code, by <br />adding a new section 134 "Urban Area Traffic Operations Improvement Programs.") <br />REQUEST TO ERECT CHRISTMAS TREE ENCROACHING SIDEWALK - GILBERT'S <br />Upon motion made, seconded and unanimously carried, the Board approved the re- <br />quest of the South Bend Neon Company, Inc., 215 Garst Street, South Bend, <br />Indiana, on behalf of Gilbert's Store to erect a Christmas Tree on the Gilbert's <br />Store parking lot extending over the sidewalk approximately seven feet and <br />b eing approximately 12 feet above the sidewalk. Certificate of proper in- <br />surance to hold the City harmless filed with the request. <br />REQUEST TO HOLD MARCH AND RALLY - "'THE SOUTH BEND PROJECT" <br />Upon motion made, seconded and unanimously carried, the request of the South <br />Bend Project by Charles S. Leone, 526 N. Hill Street, South Bend, Indiana for <br />permission to hold a march and rally on December 12, 1970, at Howard Park <br />was referred to the Police Department for appropriate action. <br />RESOLUTION NO. 11-16-70 ADOPTED - FOR THE CONSTRUCTION OF A SANITARY SEWER <br />IN ROSEMARY LANE <br />Upon motion made, seconded and unanimously carried, the following resolution <br />was adopted: <br />"RESOLUTION NO. I 1-16 -70 <br />BOARD OF PUBLIC WORKS AND SAFETY <br />CITY OF SOUTH BEND, INDIANA <br />WHEREAS, the Board of Public Works and Safety has found <br />it in the best interest of the public health and welfare to <br />construct a sanitary sewer in -Rosemary Lane from 160 feet north <br />of Hartman Drive to 583 feet north of the center line of <br />Edison Road; and <br />WHEREAS, the cost of said sewer was paid for out of funds <br />known as 'Sewage Disposal Fund' and not assessed against the <br />property owners; and <br />WHEREAS, the construction of said sewer is a b4nefit to <br />the abutting properties; and <br />WHEREAS, the policy of the Board of Public Works and <br />Safety is to charge the benefited property at a rate of <br />seven cents (70 per square foot up to 150 feet in depth from <br />the property line, <br />NOW, THEREFORE, BE IT RESOLVED, That the fee for connection <br />to the above described sewer be at the rate of Seven Cents (70 <br />
